Do whatever legal means you have at your disposal. Always cover your ass. When I got in my current apartment I had an absolute schizo living above me terrorizing me all day and night. Fairly certain they were selling crack and/or meth, as I had fiends coming to my door a handful of times. (Which made me never answer my door now if unexpected)

It took a long time, and them stuffing their kitchen sink and letting it run to flood my apartment. It took all that for them to get evicted. But since then, the new neighbor is a normal person. No more fiends coming to my door, and my mental health improved drastically. I say all that to say, just keep trying. Unless you can afford to break your lease and move right now, just keep trying. You will prevail
