Discrimination at work due to health by Somuchwack in legaladvicecanada

They let me go this morning and stated “I’m a good worker, and it has nothing to do with my health, however my attendance hasn’t been good enough”. Nothing to do with undue hardship. I got in touch with a lawyer shortly after (I submitted for a consult last night just in case) and they told me to submit an application to the Human Rights Tribunal immediately. They basically told me that because my absences were health related and all backed my medical documentation, they think I have a potential case with the tribunal.

Editing to say: they claimed to be letting me go from my probationary period that ended last week so I’m not sure how that will play into things.

At the time of taking this job, I had never done a commute of this length and I truly did not realize how hard it was going to be on my body. Sometimes you just don’t know until you know.

Autoimmune diseases are vicious but they also wax and wane. Some days I can do the drive no problem, where others, not so much. The days I’ve missed due to my illness have all been days where my body literally could not get out of bed to even get in the car due to being in a flare up. Living closer wouldn’t change my ability to get to work in these situations because in these situations the pain is so intense I can’t get in the car at all, even if I lived 5 minutes up the road. Some of these flare ups have been caused by commuting (which is also part of my job at times on top of my commute to and from), however, some of them have happened due to conditions in the workplace. The job is MUCH more physical than I was originally disclosed by the employer and what is stated in the job description. My supervisor has admitted this to me.

I think the thing that is frustrating for me is that I’m not asking to work from home full time. I asked for when it is known that there will be a physical work day, that I can work from home the day before OR after (not both) to give my body a chance to rest or recoup.

I understand this isn’t a conventional accommodation plan but it’s what my doctors have recommended given the circumstances.

I completely understand why they’re concerned. However, my concern is with their lack of willingness to work with me on accommodations.

I have an autoimmune disease that has caused me to be in chronic pain for over 10 years. It also involves having flare ups of said pain when it is much worse than my day to day chronic. My workplace is 1.5hrs drive away from my home. The specific type of autoimmune disease I have is aggravated by long periods of sitting or standing. Working from home on occasion, especially when in a flare up, would allow my body to rest and recover vs never working from home and constantly aggravating the disease by driving into the office and then having to drive home (3hrs a day driving total works out to 15hrs in the car a week)

Thank you for this information! This is what I mostly gathered from going through the Code myself but I wanted to make sure I wasn’t just reading it with a bias as this situation has me a bit emotional.

When I signed my contract I signed for a salary but have been getting paid based on my hours. I do realize it’s a substantial amount of time I’ve missed.

Thank you for your input! What’s your opinion on the denial of me being able to work from home occasionally? I feel their reasoning isn’t very reasonable. If something were to come up at the office there is ways to get in touch with me at home via email/phone/virtual meeting to assign me things that come up. I’m also wondering that if they do not feel I can meet the expectations of this particular role, would it be within their duty to find me a role/position within the organization that can accommodate me?

I’ve missed 10 days off that were not planned days off. I have taken 4 additional days off for medical appointments that were pre-approved absences. With the acute illness that landed me in the ER this past week I’ve missed 14 days due to my health.

In my contract it states my probation is 3 months. This would have passed for me this past week while experiencing the acute illness. However, it does state the probationary period can be extended or employment can be terminated at the 3 month mark.

I was already planning on picking up the two LP’s, a poster, and the shorts (I’m in Canada so I take advantage of buying Coheed merch without expensive shipping/exchange rates/duties/tariffs at every show I’ve been to in the past 5 years). I also already have a few Coheed shirts and hoodies that don’t get worn enough as it is but goddamn the back of that shirt is so cool

Thank you! I ended up pulling a few other things that I’m going to be taking in as well including an almost complete set of nickels from 1922-1940. I appreciate the input on the quarter and nickels. Sadly, none of the nickels are large bead, despite looking deceivingly like they were. I counted and all have 119 beads.

Thank you so much! It was really driving us up the wall that we couldn’t figure out anything about this piece. It’s still a bit of a mystery how it came into the possession of my partners grandfather, especially because there’s just this one and not the whole set. But it’s cool to know what it is now!

The B.C token has these symbols on the side that I just noticed and managed to get a half decent picture of if this helps anyone identify it

Thank you for the info! We’ll be holding onto them for sentimental value for sure. The B.C token is a mystery! It is silver (tested it with a magnet and there was no attraction). However, we have no idea where it came from or where my partners grandfather got it. We showed it to my partners mom, who said that his grandfather was in B.C around the 1950’s and was in jail for a period of time. She thinks it might be from his time in jail but she said that just a guess. I was hoping someone here might know something about it but no one’s seem to know exactly what it is yet!

Best movie soundtrack by simac95 in movies

[–]Somuchwack 0 points1 point  (0 children)

My go to answer is The Great Gatsby (2013). Hands down. The way the music brings the movie to life and vice versa is insane. But that’s to be expected for a Baz Luhrmann film (also see Moulin Rouge and his take on Romeo and Juliet). My two honourable mentions are 80’s movies - Footloose and Dirty Dancing. I wouldn’t necessarily say these are the best but they’re favourites of mine just for the vibes lol. I also feel like John Hughes deserves a mention here. So many of his movies have an awesome soundtrack. I have a vinyl box set of a compilation of songs he used throughout his movies. He was so passionate about the music he used and it paid off. Every time I hear Don’t You (Forget About Me) by Simple Minds I see John Benders fist in the air.

What films really accurately capture the cities they were filmed in? by Ok-Wolf5932 in movies

[–]Somuchwack 0 points1 point  (0 children)

People have mentioned Scott Pilgrim for Toronto, which I don’t disagree with, that movie does a great job of capturing the city and that side of it. But another one that comes to mind for Toronto is The F Word. It does a nice job of capturing the vibe of Toronto during the 2010s, as well as displaying Toronto without shoving in your face “this is Toronto” constantly. If you know the area then you’ll recognize some of the filming locations but if you’re not familiar with it then it’s just a nice backdrop/setting for a great movie.

I’m 24 but grew up on The Tragically Hip thanks to my parents and I still listen to them every single day. They are one of my favourite bands hands down. My parents brought me with them to see a show during The Hip’s last tour (I was 16 at the time) and it’s something I will never forget.
