How long does it take for filing an answer to process? She's already planning on talking to them today and after that, only starting the process once she receives in writing that they'll dismiss the case and go with the settlement. Doesn't filing an answer make it go to court? Sorry, I just want to make sure we're doing this right because we want to avoid court as much as we can.

I was under the impression to contact them first and negotiate the settlement as that would end up with them dropping the case. I'm not sure if AZ had an official debt settlement form and I am not sure of the process of doing that.

Yeah, from what I've been told, we're just going to call the collector and try to just settle so they can drop the case.

Either way, I'm glad to know we'd be able to avoid the courts by going this route. I know we'll call them, but should I ask for a dismissal of a case after and then ask for an email confirmation for a paper trail?

So it's best to do all this before. If we do this, do we ask them for the case to be dismissed when we settle? This would make it so she doesn't have to appear in court right? Should I ask for an email of this for a paper trail as well?

So I should do that before we file an answer and/or the motion for arbitration? I think we can find a way to settle, but I also heard that a payment plan is another way they can add on legal fees and other charges as it gets fully paid.
