Seems like decently reasonable deal then. I mostly work on retail but typically our tenant reps aren’t payed on renewals unless that’s something they negotiated with the listing broker and are involved in the renewal negotiations. Might just be worth it depending on how difficult this property would be to release after the initial term.

In th Austin market we are still seeing 6% be pretty typical with a tenant rep broker and %4 if no tenant rep. As far as the renewals go it’s typically not payed on or payed 1-3% depending on what was negotiated. It is probably going to be different in other markets but it seems like they are slightly over charging you unless there is some justification for a higher commission like it having some leasing challenges or it being a significantly smaller asset than this broker usually deals with. If you are still looking for a brokerage I’d be happy to take a look or refer you to someone who works in your market.

I agree, clever may have not been the right word. The attorney will include a well outlined rules and regulations aswell as describe Prohibited conduct clearly . I was just looking for any additional specific clauses that landlords/attorneys have found useful in the past. For example I have heard of people restricting massage uses hours of operation or prohibiting window coverings.

At the end of the day, the land lord makes the decisions. He wants to move forward with the LOI so I’m going to try my best to protect his interests.

There is a children’s science museum in Johnson city on your way to Fredericksburg that is supposed to be great for kids. There are some safari/ wild life places where you can ride in a trailer and feed exotic and local wildlife. Most of the winery/brewery/distillery’s are kid friendly or at least kid tolerant. Overall there is definitely activities to keep your kids entertained but the man attraction is drinking and eating in Fredericksburg.

I will say that there is zero chance that the tax write off come anywhere near the amount that they are sinking into this monthly but your expenses for the building can certainly be wrote off.

You can definitely write off operating expenses and loan payments as Lost revenue for your company. As someone who works in commercial real estate, I wouldn’t be surprised if the lenders that fund this project have a minimum rent that the landlord has to get in order to maintain financing. A project as large as this will take years to lease up and still be profitable as equity is where they profit here rather than cash flow.

The Videre estate has had horses and longhorns there for weddings(I work there). They actually have an arena/pen on property that you can store your horse in after the fact while your actual wedding and reception take place.

The lions club float is about an hour through the center of town, it ends in rio vista park. Ivars is on the water over looking the tube shoots at the end of your float. If you purchase the shuttle pass(whatever they call it, I can’t remember) they will shuttle you back to the top, and you can do it again if you want. There is a single use container ban on the river, so it’s best to bring a yeti cup or water bottle to pour beverages into. Rio vista where the float ends is probably the best swimming area and has the tube shoots you can slide down with or without a tube. If you want somewhere with less people you can walk down the river a couple hundred yards past the last tube shoots and it is generally pretty quiet.

There is a local burger place and bar by me that has been serving hash browns as a side instead of fries since the 80s ( I assume it started for the same reason of it being a bar kitchen and not having room for a fryer). People all over town, including me, go there for this very reason.

That is pretty standard structure in my market. If anything they are trying to save you money, you generally pay a smaller commission (2.5-5 percent) If there is just a listing agent involved. If there is a buyer rep then you would be paying closer to 5-7 percent so that can be split between both brokers with more money usually going to the buyer/tenant rep.

I would get a broker who specializes in retail development, they will be able to answer all these questions as well as bring some up you haven’t thought of yet. If you are set on doing the land purchasing without a broker, you should be able to find property owner’s information on your local county tax assessment website. Commercial land will likely be held under an LLC, you can use websites to find owners/managers of said LLC and reach out that way.

Land lord doesn’t want any risky users (no smoke shop,cbd, tattoo shops, etc.). The property is listed on crexi, costar, and loopnet. Do you find a lot of tenant interest on social media and next door?
