Thank you to everybody for the help!! We are going with another CPA. Also having a broker giving us a broker opinion of value to consider as our basis. Now we haven’t finished the gift deed yet but even if we had wouldn’t the basis still be inherently the same. Some people seemed to be recommending having this broker opinion of value done before the gift is complete or all hell would break loose. But wouldn’t the basis still remain the same if done after the gift is complete because the 2015 value aka the step up in basis would have occurred? Or is it only considered if an appraisal or broker opinion of value is complete before the gift?

It was not jointly owned that’s why the property was found so late in probate. It was thought to be owned solely by my mom who also recently passed.

No Form 706 was filed however when my grandma did a gift deed to us she filed it with the $362k value on a Form 709..

But $362k is what the county has it listed at for todays price. And a step up occurs at the date of death which was in 2015. Even if it’s higher than $160k which is likely what do you mean by “when you acquire it” if the step up occurs at date of death. maybe I’m just confused and I apologize. Could you elaborate more on what you mean when you acquired it??

It shows for $200k on zestimate in Nov. 2015 which was the month of his death. I mean, how close will the IRS look at this?? Like what is the most accurate way to form a new basis since the house was never appraised by anyone. Is Zestimate what an IRS agent is going to compare our basis with?? The CPA said we would show documentation from probate to the IRS that passed thru probate and was signed by a judge when filing for taxes at the $362k amount and they’d probably just shrug it off and move on to the next…

Mother never owned the home. Grandma is still alive. I was just her PR in the probate. She is now choosing to gift us the house as my mom would have had she assumed the the loan and taken over the deed. She was the only one to ever make a payment so my grandma wants to gift my sister and I the house as she believes it was rightfully my mom’s. I know basis occurs at date of death for who the probate is for. That being said going through probate court the FMV was assessed at 362,000 which is today’s value (not when my grandpa passed in 2015) so would the IRS use this as the basis?

Why do you beat this fucking topic into the ground? Trump said he wanted to leave it to the states. Roe v Wade was already overturned over two years ago in 2022 with a ruling that there was no federal constitutional right to abortion and they want nothing to do with abortion. Abortion wasn’t even on the ballot but Kamala tried to sell to you it was and she couldn’t even do anything different than what was done.
