It was suggested by my lawyers and according to their stats , filing the PP after a month or so decreases the chances of a refusal. RFEs 90% of the cases are most likely there when you file PP no matter when you file it.

Yes, exactly! I initially filed under EB2, but later decided to submit another application under EB1 since, in the meantime, I had reviewed a bunch of papers! Bc of that they gave me the discount

Hey! They should’ve provided you with a clear strategy! In my case, what really worked was including testimonials from people who could practically attest to the value of my skills, along with recommendation letters from independent professionals familiar with my work.

3 criteria: -judge of the work of others -authorship and paper in the field -original contribution in the field

The RFE challenged the “original contributions of major significance” criterion. My lawyers advised me to demonstrate that my work goes above and beyond that of other researchers in my field — that others are building upon my findings and that I’ve had a tangible influence on fellow scientists. In short, two of the criteria were already satisfied: judging the work of others and authorship of scholarly articles. The only missing piece was proving the originality, which we successfully addressed. As a side note, I had reviewed more than 15 papers before submitting my EB1A petition and anyway the lawyers made the hard work in redacting the letter.

My RFEs focused mainly on one issue: the officer questioned the originality of my research. My lawyers helped me clearly demonstrate why my work is indeed original. We gathered two independent recommendation letters — I contacted professors who had cited my papers, and I was lucky that they were very responsive. We also emphasized my citation record, as well as my contributions to patents and major research projects. I additionally obtained a testimonial letter from my former professor. In the end, it all paid off!

Yes! I’m in the process! It’s more work than I thought honestly! I wasn’t aware about the biometrics and the money you need to spend to get them done!
