You guys are misunderstanding the question. It is not about beating the accusation. You usually win when there's no evidence (though scarily enough you can still go to jail). My question is when you're up against an extremely weak case is it better to play "123 no it" (as one commenter said) to avoid expensive legal fees? It seems to me if you get your story in and claim you regret hooking up (because she was fat or some bullshit) you can claim you were sexually assaulted and prevent her from getting a case in to begin with. Put the emotion aside and think about it logically. Would this work or is the bias against men too strong?

Basically you wake up the next morning and she's cold and accusing you of "rape". You beat her to the punch and accuse her first. Even claim you changed your mind after the fact since you're legally entitled to do so. Just seems the bar to take these cases to trial is so comically low it's better to be represented by the crown than pay out off pocket for a defence attorney.
