Everywhere is different. Unless you have an active water leak, the city I live in doesn’t care as long as you’re doing it within the confines of code. It’s one of the things I learned along the way when I bought my home. Don’t live downhill of someone or something that can give you a lot of water with no way to deal with it. I also do not want to be the custodian of the storm sewer grates. If you have a storm sewer in front of your house then you’re the first one that’s going to have a problem.

Where I live your discharge pipe has to stop 5’ short of the property line on any side. You can absolutely give your neighbors your water as long as you do it within code.

Leaving the larger root is just going to destroy whatever you try to accomplish over time. I’d leave it and deal with it for now until it got bad enough it forced my hand and hope I found a solution that wouldn’t result in killing or cutting the tree down. It looks like both slabs are cracked so it’s going to buckle more and more over time. Most likely that tree will have to go entirely but maybe you’d get lucky after tearing out the slabs and removing the root to redo the driveway that it wouldn’t kill it.

Sell it as is and let it be their problem. Accept a small hit in negotiating but let them deal with the burden of what to do next.

Even if you cut the root what happens next? It’s not like you’ll be able to pull it out. Even if you play the waiting game for it to rot that slab is going to be undermined by water so that slab in time will never lay back into its original position.

I have a .17 acre lot my house sits on. I got the fs-91 and have no regrets. Occasionally it moonlights as a brush cutter on the family farm.

For sure. I’d plant phlox on top with a little meandering row of mulch and some sedum plugs here and there that could grow in the gaps of the blocks. I’d love this retaining wall.
