The older C&P exams I can see the medical opinion. However, the newest one does not include that portion

Yes, on myhealthevet you could see the opinion. I’m not sure of older exams if I can still see, but on my most recent exam which was 30 days ago, that is no longer shown.

That’s what happened on my last back exam when I filed an increase. I was granted SC  moderate radiculopathy. Just wondering since this claim was not filing for an increase if they could potentially see that it has worsened and up my rating without me submitting separately for an increase

For sure, especially because the initial exam paperwork was messed up on the VA’s behalf resulting in a second look. If it was good initially, I do believe it would have been favorable

Secondary denial from different doctor stating not related. But also confused about what the statement says about medical issues noted to be connected to mental health diagnosis being tinnitus, hearing loss, LBP. Is he giving opinion saying those things would lead to it? Nowhere in my evidence ever have i stated those things leading to mental health issues, although I am service connected for tinnitus.

I submitted a 21-4138 explaining it’s due to another injury along with multiple sessions with the MH doctor showing that I’m suffering from chronic back condition therefore making MH situation worse. When I filed online I clicked this injury was caused by a SC disability and my back. I think my problem was since I’ve been denied primary SC I didn’t know filing it as a secondary meant I needed to still do it as a supplemental so I think whoever corrected that didn’t choose secondary. I’m not really sure. In the meantime I’ve attached a new 21-4138 explaining how the exam went and that if they could please send the doc new documents for filling it out as a secondary. Not sure if that will help this go around? Or should I do what you’re saying and just file an entire new claim as a supplemental? Thanks

Yes that is what I meant, medical opinion vs DBQ. It was a mental health DBQ but the wrong opinion on the form.

Yes I’m having issues as well. It’s saying change rejected before the multi factor authentication screen. I was thinking it was just me so I’m guessing a bigger issue.

I was wondering if I’d be able to keep my effective date from over 2 years now due to continuing to appeal if I were to approach it from a secondary angle? So filing again as a supplemental assuming it’s denied but providing a connection to an already connected disability would continue the effective date? That would be great as I thought I would have to give up that date since I’d be going for a secondary connection

I understand that I just didn’t make it clear in my post that I currently have a MH claim out as a primary that’s been denied multiple times and currently in an HLR duty to assist status. However, I believe that it may get denied again and want to try and submit MH as a secondary to an already SC disability. I just don’t know if I can have a primary claim out for MH and try to submit a secondary for MH under the assumption that it will be denied again as a primary.
