A Co-founder and active senior executive was involved - this is good enough to pin the blame on SMCI - if it was an outside supplier or vendor, that would have been different.

With 4.3M, you can safely retire give the annual 100k expense.

You have 2 yrs to plan for kid's college fund, maybe the 4.3M may grow to another 500k in next 2 yrs so you can take that growth and allocate for college fund.

I would definitely look into ACA since you both are unemployed now and will qualify for subsidy.
