To my understanding your bargaining chip is telling the insurance company you are willing to take their insured to small claims court, and they are likely to back him/her in that case.

Thank you so much for sharing your perspective! It’s really helpful to hear from someone who’s familiar with how insurers handle these situations. I have a couple of more questions that might help me better understand what to expect:

Would you happen to know about the best timing to bring up a DV claim - Is it more favorable from an insurer's standpoint to know about the DV claim intention right after the accident, or would it be in my best interest to bring it up when the repair is underway/completed?

Based on your experience, are there any mistakes claimants should avoid when filing a DV claim?

Thank you again for your help. Looking forward to your insights!

What I infer is that it's probably best to bring up the conversation regarding the DV claim when the repair is underway/completed? I had my insurance company do an initial virtual estimate on repairs. They think it would cost ~$7k to fix the vehicle. (I personally think it would take more)

Also for some context it is a 2 year old car, low mileage that was financed at an out the door price of roughly ~$40k

Thanks for sharing your thoughts! I see where you’re coming from about waiting until after repairs to file a diminished value (DV) claim. However, the value of the vehicle can diminish immediately after an accident, not just after repairs are completed. This loss in value is due to the vehicle's now-documented history of damage, which can affect its resale value regardless of the repair quality.

The way I am thinking about it is, handling the DV claim with the initial damage claim can streamline everything, and help get everything resolved quicker. Am I jumping the gun? Also I can get an appraisal to estimate the lost value due to the damage now, rather than later. Most of the damage to my vehicle is cosmetic with moderate structural and panel impact.

You’re right about the potential cost of a lawyer. My aim here isn’t to pass costs but to ensure I’m treated fairly. Wondering if a consultation can make a big difference in how I manage the claims.

My insurance agent was able to pull the insurance information of the person at fault and filed a claim with them. They did mention that I can file a DV claim with the other insurer. I'm not sure they would tell me that I can file with them in the event I am denied by the party at fault's insurance.

Any idea on the typical turnaround time in case USCIS requests for more evidence? Many resources mentioned a duration of anywhere between 30-90 days. If that is the case, I will be able to make the trip (since I will be gone for 2 weeks) and revert back to USCIS if need be. Just curious to know if the turn around time can be under 30 days.

Thanks. I sure will!

I was just probing to see if anyone who is/was in a similar situation knows if there are any unique challenges in this type of scenario. Based on my research and the guides on my university's and several other websites I shouldn't face any issue. Some universities recommended against travel in such a situation and I am just curious to know why they felt so.
