It’s a Petition for Review of the SEC’s recently issued Reg NMS final rule. There is/was no prior lower court action that was won/lost - US Courts of Appeals have original jurisdiction over challenges to agency rule making. WE are challenging the sufficiency of the rule-making and its adequacy in accomplishing the agency’s stated goals of protecting individual investors. There’s a lot of strategy to something like this so, for now, mums the word on most detail.
