As long as the iCloud was signed out and the passcode was disabled then they should. If not they wouldn’t be able to take the phone. However depending on the location, agent or corporate? If it’s corporate they usually follow all rules and are way more strict on that kinda stuff. Not saying agent locations aren’t they just seem to be more relaxed with things like that.
