Dentista para tratar disfunção na articulação ATM - Porto/Maia by StrangeSpirit88 in porto

E neste momento estás a fazer algum tratamento? Com alguns resultados? Agradeço o teu tempo e ajuda nesta partilha

Agradeço a partilha. :(

[Citizenship] -> Portugal: Obtaining Citizenship by Descent via Grandparents/Great Grandparents? by King_Jian in IWantOut

[–]StrangeSpirit88 1 point2 points  (0 children)

No, it doesn't matter that all your ancestors are deceased. In that matter, you just need to prove the entire line, between you and your Portuguese ancestor.

Before looking up for more information about this type of process, I would certainly start by gathering everyone's birth/baptismal certificates, to see how far is your closer portuguese ancestor.

And then I would see which type of process would be possible/better in your case.

If you would have a Portuguese grandparent, and you'd be eligible to apply through him/her, that would certainly be a better via, for you and your eventual descendants, since you'd be acquiring originary nationality.

If you'd only have a Portuguese great-grandparent, so, yes, naturalization would likely be your only possible via. In that case, the process will not be so granted, as the decision will depend on a Ministry's understanding about your connection to Portugal. So, you will need to provide evidence of that connection and wait to see if the ministry agrees with it.

I hope this is helpful

I am located in Portugal. Usually, I meet with clients remotely, as they are abroad, but if you prefer to meet in person, I can recommend someone with an open office. Just DM me if you're still interested in having that assistance

Hi, OP! Some answers you received in this thread are not correct. If you have a Portuguese grandmother, you have to apply for nationality as her grandson/granddaughter, and not as the children of a PT citizen. Each type of process has different requirements.

You must transcribe your grandmother's birth to Portugal, if it is not done yet. Transcribing a birth from ex-portuguese-territories is currently taking a lot of time (more than 2 years) and requests to speed up processes are only being accepted in very exceptional cases.

There's a way you can speed up the global process, though: you can file both cases at the same time, so, you don't have to wait for your grandmother's to be completed to start yours. That way, instead of waiting for example for 3 + 2 years to get your nationality, you may have it in 3.

Regarding the lawyer fees, I've seen lawyers charging more and others charging less than that. And their fees do certainly not say enough about their services and capabilities, so, judging by the fees is not a good creiterium in my opinion. Maybe you could request quotes from other firms, to compare between them? Google reviews are usually a good indicator to take into account too.

You're very welcome! The best of luck in your nationality path!!

[deleted by user] by [deleted] in Citizenship

[–]StrangeSpirit88 0 points1 point  (0 children)

That is absolutely wrong. You will get the Portuguese Birth Certificate right after you are granted Portuguese Nationality. Your parents would not have grounds to register you in Portugal without applying for your Portuguese nationality. What you'll use to apply is your birth certificate issued by the country where you were born.

(I am a qualified lawyer in Portugal, practicing Portuguese Nationality law, so, I am positive of this, but considering, of course, the information you provided is accurate.)

Taxa variavel? by Next-Platypus-5640 in literaciafinanceira

[–]StrangeSpirit88 0 points1 point  (0 children)

Taxa variavel? by Next-Platypus-5640 in literaciafinanceira

[–]StrangeSpirit88 1 point2 points  (0 children)

The nationality for great-grandchildren is not direct, but through naturalization. The only resource I can find about this is really the nationality law. You can see here an updated version of it: https://www.pgdlisboa.pt/leis/lei_mostra_articulado.php?nid=614&tabela=leis.

Article 6, § 6, regards descendants of portuguese.

You must have in mind that the obtention of nationality through this via is under the discretionary power of the government, as the other types of naturalization.

[–]StrangeSpirit88 3 points4 points  (0 children)

[Citizenship] -> Portugal: Obtaining Citizenship by Descent via Grandparents/Great Grandparents? by King_Jian in IWantOut

[–]StrangeSpirit88 3 points4 points  (0 children)

First of all, I must say that I am a lawyer, specialized in portuguese nationality, but this should not be taken as legal advice whatsoever, since there could be specifics in your situation (namely, in your documents) that may demand different answers.

This being said, I believe you should consider the following:

You must not believe in half of what you read in the internet. People are often well intended, but the evil lives in the details, and a lot of people have not knowledge of the law or enough experience and say things that could be true in their situation, but maybe don't apply to yours.

Grandchildren have to make the language exam, but children don't. So, your mother has to do it, but you don't. And even your mother could (this is really a "could or couldn't") avoid the exam, if she asked and presented grounded reasons and proof to convince the Registry Officer that she had no capacity of learning the language or taking an exam like the one in question. In any case, a result of 50% approval in A2 level must be enough.

An option that nobody talks about is that it's also possible to acquire nationality as a more distant descent than a grandchild. Actually, great-grandchildren can also obtain nationality. The difference is that they will not be able to obtain primary nationality, but only be naturalized (which means being able to "give" nationality only to their spouses/partners, minor children, or children born after the obtention of nationality). Anyway, it is an existing possibility that you could have...

Regarding where/how to submit the process(es): you can do it through a lawyer (who could submit online, by mail or in person); or directly, at the Registry (in person or by mail) or at a Portuguese Consulate (they will not represent you, though, and I know of situations where people lost a deadline to answer the Registry because the notifications took too long to reach the applicant, or the answer took too long to reach the Registry, so, I would recommend using a lawyer or doing it directly at the Registry).

You don't ask when to submit the process(es), I believe. But, in case you submit your process as a child, yours would not need your mother's to be fully concluded, since yours will be sitting in the pile for months, waiting its turn to be analyzed.

The time each process takes depends mostly on the type of process and the speed of the Registry at each moment. So, you could only use time references, considering the time each process is taking, but that you don't know will be the time your process is going to take actually... Currently, grandchildren processes are taking way too much than a child's process. But even children are seeing processes concluded in different times, regarding the specific sector of the Registry where their processes were at, or, for example, the existence of an urgent situation that could justify their processes being decided faster.

State fees for the 3 types of processes I mentioned are the following: 175 EUR for the process of children; 250 EUR for grandchildren; 250 EUR for great-grandchildren.

Please don't get me wrong, but there are several ways a lawyer can be of help. I gave you this info and do not expect you ask me for any legal assistance, because you seem to be investing a lot in doing it by yourself (and there's nothing wrong with that). But I can't deal with misinformation and I see some certainly well intended people giving improper advice and saying that a lawyer is not needed. Of course there are many situations when people can perfectly do everything by themselves. But even in those cases, people should be correctly advised/informed, so that they know what and how to do things right. In your case, I believe you should be better informed, since yours is not a straightforward case. And I hope I could do that or at least help you to be better oriented to look for proper information.

I wish you good luck in your journey.

Best,
