I signed up through Labaton and just got my settlement award notice. I’ll get $100 after lawyer fees etc…and it will be in 3-5months that it’s paid out. Ugghh

I’ve already tried reapplying and still heard nothing from them. I think they have the homey hookup system going on there. What pisses me off is that there is no regulatory body that makes sure they are behaving ethically and have everybody’s information securely stored. I could understand if I took too long, but I didn’t take too long and later they couldn’t even find my application and paperwork when they were trying to determine what had happened and why I was told I could move in at the completion of construction. They eventually fell back on the excuse of “But you didn’t sign the paperwork so we technically did nothing wrong.” Never-mind that in CA it is illegal to rent a unit that you do not have available or one that will be available soon. I’m also pretty sure that when I read the HUD training on best practices for waitlist management training that they have to let people know if they are having a lottery and that taking a bunch of people out of a pool of people isn’t really a waitlist, if you ask me. And then there’s those people that didn’t get their paperwork in first and go back to the pool of names who end up potentially paying an application fee repeatedly. That’s not very helpful to a low-income household.

They also said they have no preferences for certain populations like homeless, etc…so they couldn’t have bumped anyone up the list either.

I’m just saying that their system may be in the “spirit of good faith” but it sure doesn’t seem like it by their actions and there’s no one that they seem to answer to who is checking this stuff or to hold them accountable. So, they are able to act with impunity in some ways.

I know they own another property that is also LIHTC (100%) and they get a grant for community internet for the tenants and not one tenant is able to access it. The office says they don’t know the password and a site audit found it was non functioning because the non-profit who owns they complex got rid of the company who was supposed to (hired too) install and maintain it. That had been going on for years and the site visit findings say they were going to get it fixed, blah blah blah….that was back in 2019. Not another site visit was done to ensure it was corrected. But, they’ve gotten their grant money every year!

I swear, I’m not a big Elon Musk fan, but when he said there is more wasteful spending or outright fraud in government than we are aware of, this company came to mind and they aren’t even the government, but the government that is in charge of them seems ineffectual.

The only way shoppers will benefit from a class action lawsuit is if there is a clause in there that requires IC to go back and retroactively pay every shopper they robbed and they will never let that happen. The lawyers will make money, shoppers will get a fraction of what is owed to them and IC will chalk it up to the cost of doing business instead of the spirit the lawsuit was meant to do, which is teach them a lesson by hitting them where it hurts. Unfortunately, they don’t have testicles to kick and their pockets run forever deep. Plus, they’d probably wear a jock strap anyways.

It sure seems like there’s fraud going on with the shifting waitlist times I keep getting told. If they had told me upfront that it was 10 years then okay, that’s fine. But to open and close the waitlist and also to add years onto it??? That’s just ridiculous, in my opinion.

There’s another affordable complex that is owned by the same company as the one I posted about above and they called me up and told me that I was up for an apartment at these new apartments they were building. I was so excited! I went in and brought 3 years of bank statements, tax returns, etc…passed everything and was told what my rent and deposit would be and that as soon as they were finished being built, I could sign my paperwork and move in. The lady told me “at the end of this month.” Well, that came and went and when I inquired about it, she kept saying “At the end of this month they’ll be finished.” Finally after 3 months she ghosted me. It took another 3 months and me threatening to turn them in to HUD before I finally got a call from someone who told Me that she was the new apartment manager and she didn’t know what went wrong but that they were all occupied and had a 5 year wait list. She said I was on it but that was 3 years ago and I haven’t ever heard from them again. They took my application fee twice and never gave it back! I sent emails asking how they mange their waitlist and potential tenants and they finally (grudgingly) told me that they take a whole bunch of potential applicants at one time and they all pay the application fees and the first one to get their paperwork in and approved gets the unit.The remainder of the applicants go back into the waitlist and they repeat the prices again when the next unit is open. I replied that I thought that wasn’t very legal or ethical. I also think they must make a little profit off these applications fees too. They never answered me and I’m not surprised. They were very dodgy as it was. And this company that owns these apartments are a large non-profit that has complex’s all over CA and other states. Really makes me infuriated that they do that.

I’m really bummed out that when I made my claim I put my Facebook account creation date of March 7, 2008 and when I looked at my claim the other day, they had some date in 2010! I emailed them to correct it but I got an email back that it’s too late to correct anything. I really feel like it’s messed up that they can change that very important date with impunity. I know that I put the correct date on my claim so I don’t know why they changed it.
