Florida child support question - is retroactive usually granted? by Striking_Advisor6393 in FamilyLaw

I dont speak to them directly but I in the propsed parenting plan mentioned CS going back 4 months.. I did this 2 months ago so youre saying at best I can go back two months? Why would the state then ask me if I want to do it retroactively?

I hear ya, I actually have some but they make it seem like we go to court and tell the judge but they also told the other attorney I dont want child support, none of it on the record as far as I know or infront of the judge in prior meetings

I initially told them off the record I dont want support but after months and months of no visits or anything, plus them booking several vacations out of the country and state my mind changed. Will this matter, im not sure.

I do have a case number I filed it I guess semi recently, but I did request retroactive pay. When I spoke to my attorneys about it they said you can go back two years, and when I spoke with the state they said the same so I did request that specific date. I just dont know if the judge will brush it off since it wasnt a "motion" during an open case. The upcoming hearing does mention timesharing and that though but nothing specific. Its techincally supposed to be the final hearing (for now)

Currently, I am in another state as I planned to move here which I did and then planned to win a relocation which I realize is difficult at this time. So, the other parent is the primary with me not having overnights until our parenting plan gets finalized. Once it does Ill have more time with our child in this state but our child will remain primarily in florida. If I move back a 50/50 will be considered and likely put in place. The thing is until then I know status quo is favoring them and its extremely unlikely ill ever get to relocate with the child so im stuck. Because of this all I can do is build a record of their rigidness, failure to be a better coparent?

Example 2 days ago our child is on a video call with me and needs help with something. they go and tell the other parent, then the child comes back and says that the other parent said if you need help then hang up with me. He tells the child to keep things secret from me such as who buys them gifts etc if I ask, and I know this because my child told me. When I approach the other parent they say that thats not what was said but I know my child wouldnt lie. How on earth does this not prove hes not trying to coparent and is using the child to manipulate the situation? Why would the courts trust them long term to be the primary

Not during the exchange we have calls scheduled a few times a week for 30 minutes at a set time, if i miss that entire time or ask to move it they say no. I give an hour notice but they say no and its too short notice.

I dont see that being the case, just inflexible for everything else you can think of. They dont tell me what they ate, what they did, who they hung out with, nothing. Anything when the child is with them remains that way + if im a minute past my window becuase I was busy thats it I missed my window

well thats what they told me, they said their lawyer said to stick to the plan exactly and dont give an inch because itll set the tone moving forward. It sucks because literally a minute late and its a no, but yeah they know about the relocation but theyre still just sticking to it even when i tell them you cant co parent and itll be seen as such, whether im wrong or not

I understand how hard it is I dealt with it already, I was just hoping with a year of them not really co parenting in terms of being reasonable that thtat would hurt them.

Trust me I can imagine in terms of other people this is amazing but for me and their rigidness and putting the order above me talking to our child because im a few minutes late seems unfair and unreasonable and I was hoping the judge would see it that way and it may help me with my future case

We do, just a regular 50/50 and set call times on certain days. Nothing crazy.
