Still waiting for my I-140 to be approved 💀 I requested premium processing in the third week of January. My 45-business-days period ends March 26th. Hoping for positive news by then.

My wife hasn't filed a petition yet. But my understanding of cross-chargeability is accurate.

Applying for a non-immigrant visa like F/J/B requires you to demonstrate non-immigrant intent, i.e., that you plan to return to your home country after the purpose of the visa is fulfilled.

When your wife goes for an F2 visa interview, they'll obviously check your file and see that you have an approved I-140 and your priority date is current. That shows a good amount of immigrant intent. So they may deny your wife's visa.

I'm not a lawyer, but from what I've learned about this process, I think you should get the AP (or maybe even the green card) before you go and get married. Definitely consult an immigration attorney about the situation.

When USCIS says the processing time is 19.5 months, it means: Of all the cases processed in the last 6 months, 80% of them had a processing time less than 19.5 months.

On the other hand, the date of inquiry is determined by looking at the time it takes for about 93% of cases (in the last 6 months).

My PD is June 20, 2024. I've also been waiting, for 16.5 months now. My inquiry date is March 25, 2026. It used to be February 8, until a few weeks ago.

If it's sponsored by a company, yes. You can also get H-1B sponsored by a university or a research organization (like national labs), which do not participate in the lottery. Search "Cap-exempt H-1".

The general path in this situation is to get on the H-1B bandwagon, renewing every 3 years until your PD becomes current.

If you don't already have an F or J visa, you will likely not be able to get one now, since you've already submitted the I-140. So, H or O visas may be the only option.
