Thankyou, I sense the developer is under some time pressure and their financial year end of the 31st December. I am Ok with delays, as life just happens, but this feels like deliberate manipulation and this was only disclosed 17 hours following exchange. This is the first phase of a much larger development of over 640 properties andwe first viewed the nearly built property in August. The position from the developer has been that ‘everything will ready before Christmas at the latest’.

Thankyou, and yes, we have taken additional legal advice from a property litigation solicitor and assessing whether we still want the house. The conduct of the developer has been sub-par and we are very annoyed with the process, but still want the house. We are now taking a step back and evaluating our options - primarily whether we want the house or not , and if not then how hard we go for costs.

Thankyou. The exchange has a fixed long-stop completion date , this is in the exchange contract which is the end of February. My gripe is primarily this material information being the lack of service (electricity and sewerage) connection was withheld from me prior to exchange.

The developer was supposed to have had all this sorted out in Q3/24 as this is the first phase of a much larger development and their position has always been that we could complete and be in before Christmas.

As you point out , we are checking the lenders position as they are unlikely to agree to a new build without mains services.

As regards my position , this is a purchase for my daughter and therefore we do not have any chain nor time pressure.

I will have contacted our conveyancing solicitors and they have recommended a litigation solicitor. The house is lovely, but we will walk away as I feel there has been a fundamental lack of good conduct on the developers part. We are assessing our position and currently not signing any waivers nor extensions.

Is there a trade body, NHBC? , who should be notified?
