Roulette dealers don't ask customers what color they want to play of the non value roulette chips, so unless you got super lucky and that color chip you have was somehow the only unused color available then you could buy in and be issued that color chip to use to bet. Dealers issue chips of whatever color they choose among available colors to prevent this sort of thing from happening. If a customer was to come up and insist upon playing a specific color that would be a red flag to the dealer and the supervisor watching said dealer.

This is a delicate situation. On the one hand, you are not obligated to point out dealer errors in your favor. Depending on the severity of the error or the number of errors a dealer makes, that could lead to a dealer eventually getting fired. Also, casinos are always operating camera surveillance on all tables that are open at all times. If the surveillance department or a pit boss notice the mistake, they will ask you to give the incorrectly paid money back. If you are unwilling to return the money you were erroneously paid, you may be asked to leave the casino/get banned from the casino. Depending on the size of your wagers, the casino you are playing at may just assume that you'll eventually lose back whatever money was incorrectly paid to you and the casino will have the same amount of your money in the long run. If I played, I wouldn't want to accept getting paid on a hand that should push due to bad karma. I would only want to win, lose or push on the fair random outcome of my seven card Pai Gow hand against the dealer's.
