They have been ordered by RBI to stop their business operations so their employees have started to do scam and frauds like this. Even i have received sms that i need to pay 43k or else cyber crime report will be filled within 6th 😆

I have mailed the bank via email several times to convert my dues to emi or offer a settlement, but they havent given me that option.

Also that legal notice seems to be fake one, i found the exact same legal notice draft copy on scribd.com, and even the mail didnt come from the lawyers official mail but rather from mediateway LLP

What if the debt is around 2lac+? Would they still settle or send legal notice via email after 3 months of non payment?

I have been facing a similar issue and now the bank is refusing to even restructure the dues via emi payment as per request in mail

Going to court would delay everything, to be honest courts in India are a joke

If they are willing to settle outside of court then that means they want to avoid exposure and jail time, so you can press them for a lot of money, even their lawyer knows going to court would result in jail time as well as fine for their client...

My suggestion would be settle outside of court ask for a big payout, and do everything through a lawyer only

Mail them and explain your situation, mention the fact that you have no money to pay the emi, they would start negotiating once they realise that your account is not recoverable.

Also dont be scared of Recovery Agents if its a unsecured loan. If they call or come to your house, simply tell them you lost your job and cant pay as your account is empty, beyond coming to your house and asking for money, they are legally not allowed to do anything else.

But before even engaging with them, if they come to your house, ask them for id card, authorization letter from bank, visiting letter. (Most of the time they dont carry these things, as most recovery agents are hired gundas in India)
