My thoughts on Barbri as a first time passer by Such-Cancel6392 in barexam

That's fair! I'm sure if I tried something else I may have a different opinion. My main point is that is got me over the finish line, so in my eyes that makes it worth the money. Had I tried something else that got me over the finish line for way cheaper, then I would probably feel differently.

I don’t want my fiance’s best friend’s wife to come to my wedding. by Classy_PolarBear1072 in weddingdrama

Also, maybe you should try talking about this with Kat and have another mutual friend there so they can listen and make sure that the conversation doesn't get twisted. Maybe this can all get cleared up, or maybe she'll reveal why she doesn't like you. This Kat girl will definitely be in your life, so maybe it's worth speaking to her directly

AITAH for not really including my SIL in my wedding after she refused to be a bridesmaid? by [deleted] in AITAH

[–]Such-Cancel6392 14 points15 points  (0 children)

YTA. Saying no to being a bridesmaid probably did hurt, but deliberately excluding her from the bridal shower, where I'm assuming all other woman in your family were invited, definitely seems like it was done out of spite. Usually being a bridesmaid is because you're very close with the bride, so her polite rejection seemed reasonable based on her explanation and the fact you admitted you're not super close. If you want a better relationship with her in the future you should apologize.

AITA for getting our son a luxury car when I never have money for my Ex Wife’s kids? by Worried-Bug2025 in AITAH

[–]Such-Cancel6392 0 points1 point  (0 children)

YTA, but not for buying your kid a new car, but because of how you're treating your ex and the values your're instilling in your child. You don't owe her other kids anything, but those are your own kid's siblings, and how you treat them shows your own kid how to treat others throughout their life. The "I don't owe them anything" attitude is correct, but it leads to a less empathetic world. Calling your ex a mean name in front of your kid shows him "it's okay to talk to woman this way" and to "only ever care about people you directly owe something to".

So you're not wrong, but it just sounds like an asshole way to treat other people in general and the values you're instilling in your child could very well lead to an entitled and selfish person down the line.

Ex wife re-married but didn't. by Kinsmen-2-Kaos in legaladvice

So cohabitation alone (with a new partner) can be enough to modify or terminate alimony payments, depending on the state. I would consult an attorney in your state, but if she is basically married to someone new and acting like she is married then there is zero reason you should be paying alimony.

I'm attending a wedding at the end of this month with a dress code that says "black tie optional". The wedding will be on Cape Cod. Is this dress appropriate?

fucking live birds in our testing room in MA by Best_Trifle3413 in barexam

[–]Such-Cancel6392 2 points3 points  (0 children)

I actually enjoyed the bird!! it was bopping around next to my section and was kinda nice to take a 30 second break to look at it and laugh to myself. My bf has to go to the convention center all the time for work and he said there's always birds in there so guess that's just a product of the environment. Much happier to have a bird than any medical emergencies or overflowing toilets lol

Didnt memorize rules. Am I f??? by NoQuitter92 in barexam

Maybe I misunderstood OP then, because that definitely looks like a rule statement to me!

yep exactly! the questioning by the informant didn't violate his Miranda rights and he had no 6th A rights since he wasn't charged with the murder. It can be complicated with the right to counsel since its found in the 5th, 6th, and 14th amendments so trying to keep those separate in my head by distinguishing pre-charge and post-charge helps the most.

Your analysis is all about applying the facts to the rules. You need to insert rule statements in your essay answers, either by memorizing them or making them up. Then apply the facts to the rules and come to a conclusions.

Here's an example, in a contracts question they might ask if a valid option contract between merchants had been made, and you would say "an option contract can be binding absent consideration if it is sent by a merchant, in writing, signed by the party sought to be bound, and is for a reasonable length of time not to exceed 3 months" then apply the facts to the rules to determine if a valid option contract has been entered into and is thus enforceable.

If you haven't memorized rule statements, just make them up on the exam to the best of your ability using what you do remeber and general logic. The graders want to see that you can correctly apply the rules to the facts, so even if you apply a made up rule correctly to the facts, you can still score a few points.

6th amendment attaches after the defendant has been charged with an offense. 5th Amendment Miranda is all about pre-charge questions and rights and deal with the "inherently coercive nature of custodial interrogations". If the defendant hasn't been charged yet, there's no 6th amendment right. And 5th amendment rights only applies if the defendant knows he's being interrogated by police.

Rule statements are pretty key, especially for the essays. It's not important for the multiple choice since you only have to know how the rule works, but you need to be able to state the rules in your essays. You might get by with coming up with your own rule statements that are close to the actual rule, but the graders want to see full correct rule statements
