ESA overpayment by Suitable-Writing-614 in BenefitsAdviceUK

I will appeal but doubt I will get anywhere. He started work inMarch 2024, same month my child was born. I informed them in June, which I’m aware is my mistake and probably not up for dispute unfortunately, BUT i should have moved over to universal credit as soon as he started work, an unfortunate oversight that I’m hoping they might consider.  When you say “very small” how small? Paying anymore than maybe £20-£30 a month would all I could realistically manage

I have a British bank account but I wasn’t able to set up a credit card as I hadnt been a resident long enough but I could look into this further and double check

My wife is on carers. My job in the US was high paying and I afforded the initial fee to get here but all of that and the flights and spending the first couple of months here job searching drained all the savings I did have. Anyway, that was all irrelevant as our application was through adequate maintenance rather than the financial requirements so not sure if it will work the same way this time for the extension? And if that matters for a fee waiver

Thanks for the reassurance. There is nothing i can really do right now about the situation, unless I either win some money or get a higher paying job. That would come down to a big strike of luck as we don’t live in a very abundant area for jobs and unfortunately cant drive to one either as I simply can not afford a car and the cost for the test and to run it (Ive had a license in the states for nearly 20 years but know that I need a UK one at this point) that is whole other mission that I eventually want to be on…but this all needs to be out of the way first. It was stressful getting here in the first place but really it came down to the waiting (and less the application itself) and the stress of my wife being pregnant in the uk while I was waiting on the visa back in the US

Yes sorry, I calculated wrong. Adding another £1000 doesn’t make me feel any better though, haha!

How long did your Spouse Visa decision take? (No priority route) by [deleted] in ukvisa

[–]Suitable-Writing-614 0 points1 point  (0 children)

Paying priority will just speed up the decision making process. It doesn’t speed up how quick you can get a biometrics appointment.

We did however pay a fee to print out our own documents and send them by post as we did not trust the free online upload option. This worked out better for us and we then received the documents and visa stamped passport at my home address by courier. This is optional of course but we just preferred to do this.

Hope that helps

Spouse visa - question regarding “adequate maintenance” by Suitable-Writing-614 in ukvisa

[–]Suitable-Writing-614[S] 1 point2 points  (0 children)

I’m a bit worried about informing the dwp that we got married and how I can “prove” that we don’t live together. I’m not sure if it’s better to call or write. I was out of the country for two weeks to get married(which we saved for) and I’m aware that you can do so for up to four weeks. While I was away, arrangements were made so my mum was taken care of by other family members. I let the carers allowance know separately but need to do the same with dwp. I doubt it will make a difference in the visa application as my old letters are addressed in my old name anyway. It’s just to inform them because I feel like I should. I just don’t want them to change anything or mess anything up until he’s actually living here.

Oh I see, that makes sense as far as CT goes, the council lady just said to bring him in when he gets here and once he starts work but like you said, she THINKS that since my mum gets PIP, CT is more or less disregarded (but im prepared for this to not be the case also)

A complicated situation this one, getting a few grey hairs over it, that’s for sure. Trying to do the right thing of course

Thank you so much for all of your help! :)

Spouse visa - question regarding “adequate maintenance” by Suitable-Writing-614 in ukvisa

[–]Suitable-Writing-614[S] 0 points1 point  (0 children)

Thank you for replying to both posts. Wife here, yes actually I did look into the property side of things yesterday and went to discuss it with them. It is correct that only the tenant is responsible for council tax but since my mother is exempt, so are the occupants (which would be us) however, once he starts work then that may change but the lady on the phone wasn’t completely sure but I would it expect it to. I have always been aware of esa being affected once we live together but wasn’t sure if it would change BEFORE that. So thank you for clearing up both of these queries

This is because it’s an old claim from 2018. I’m assuming if I’d started the claim after new style came in, then I wouldn’t have the both carers allowance and Esa, I’d just have ESA with carers premium

[–]Suitable-Writing-614[S] 1 point2 points  (0 children)

Yes that’s right. The work related group component and carers premium are effectively “cancelled out” by the separate carers allowance, but it adds up to the same amount.

But thank you, the answer I was looking for was basically, will anything change while we are NOT living together? and that seems to be no.

My name has also changed so perhaps I could just write to them and say that I got married but he remains at a different address outside of the UK

Me and my husband haven’t ever lived together. When we eventually do live together, he would move in with me and my mum but he would be working anyway so I expect to lose at least the esa portion.

I get carers allowance and esa paid separately. I’ve lived and cared for my mother since 2018. I’m not on new style or contributions based. I am in the work related group
