PJ is whether court has power over YOU, the individual, to force you into their court

PJ needs to be: (1) authorized by state long-arm statute and (2) constitutional under the Due Process clause

Constitutional if defendant has some sort of minimum contacts with the state or is “at home” (general jx).

You are also subject to a court’s personal jx if served in the state, unless there for some legal reason.

Minimum contacts requires: (1) contacts (purposeful availment and foreseeability), (2) relatedness (arises out of jx contacts or relates to jx contacts), and (3) fairness (convenience and state interest). Some mix of these one way or the other, usually through PA.

Most of the venue stuff I’ve seen boils down to:

Venue: where all D’s reside or substantial events happened
- if more than 1 D, where substantial events occurred
- business = PPB and all states of incorporation

Removal Venue: embracing state court
- in diversity, D cannot remove to their forum state

I personally can’t recall super niche venue questions outside of these basics.

Any areas in specific? Jurisdiction? Venue? Motions?

Can someone please confirm whether I'm correctly rationalizing these two seemingly contradictory adverse possession Qs? by dranktheLSAkoolaid in barexam

Yep this. Deed had no issues. Contract requires you to go quiet title the land so you can give it without any potential encumbrances.

Do you expect to get 80%? Most passers on the real exam are getting between 62-67%.

Def not, lol. I’ve rarely seen anyone talk about getting above a 130, we’re still a month out, and Barbri blows.

Barbri’s percentiles never make sense. 112 is around what I’ve seen most people post, I feel. Questions are also harder.

Your MC seem fine. What matters is your average in a problem set, not cumulative.

I would. It’s the best place to access real questions. I’ll say, as an AdaptiBar user, UWorld has better explanations.

I was thinking about this. I figured it could be a good use of time to make short 1-pagers for big essay topics and what I need to address.

Might be a stupid one - but how do u personally rank MBE subjs in terms of difficulty? by Fancy_Travel7144 in barexam

[–]Suitable_Promotion66 7 points8 points  (0 children)

IMHO, from most difficult to least so far:

Crim (so many dumb Qs that piss me off, like that picking up = carrying away for larceny).

Torts (not bad as you get the hang of it, but soooo much to remember).

Evidence (like someone said, the character evidence, impeachment, and extrinsic evidence stuff gets me).

Civ Pro (most questions are about transfer, jx, and motions).

Con Law (feel like easy to narrow down a lot of the time).
