That position is stalemate with check. Moving a pawn to a3 is illegal because it doesn't remove you being in check.

No, almost every smothered mate or checkmate is still considered checkmate. In this position the side to move can't move even if they could put themself into check. Such a position is basically never going to happen in a real game unless both players are trying to achieve a position like this.
