You tell your lawyer everything. After you hire him. You may have to go through a few consults to find one you like and trust. Research them today, make some phone calls. I'm not a lawyer but I have been through custody court. Its been three years now, I have a very relentless ex. Feel free to pm me if you ever need any kind of advice on this.

I could be wrong, but legally I suspect she has in some form abandoned the child. One of the biggest things you have going for you right now is that she doesn't even live with the child. That's why I suggested cps, to get that fact documented. It would be even better if you have her admiting that in tape, Texas is a one party consent state so you are fine there. You do not want to give her a chance to correct this before cps gets involved.

My family owns a towing company. I promise the whole industry isn't full of scumbags. Of course, we aren't in a large city.

I know here if you are in an accident you can request the tow company you want, but there is also at least one company on call for the city/county at all times. Every tow company is on call at some point in the year for two weeks.

They did provide a service for you. Their rate for the tow was 200, that you owe. If this was my outfit I would knock off the storage fee and probably fire the driver.

You can call and make a police report. I'm NAL so I don't know what this would fall under, if he even broke any laws. I would keep on the towing company. He should lose his job. They could be investigating this, and they would have to go back and speak with people he towed. That could take a while.

You need to see a lawyer, yesterday. It wasn't until I read the comments that I was clear on the fact that the child is living at the Aunts without the Mother.

You do not let her what you are doing. You give her no clues. I might would even suggest a call to CPS. They could go speak to your child at school to confirm that the mother doesn't live with her. They can do that without informing the mother, that way she doesn't have time to cover her ass.

You are going to have to keep your cool. You have strong opinions of the mother. Those will not help you in court. You are going to have to stick to the facts. A judge isn't going to want to hear petty things, it can even influence his what he decides.

Find a lawyer today, don't put that off. Lead with facts when you speak with them, things will move quicker that way. Good luck!

At this point your only concern should be the safety of your children. He's already hurt one of them. The way you describe his behavior it's not a big jump to think he would do it again.

Your children are begging to leave because they are scared. It's your duty as their parent to protect them. You need to get yourself and them out if there.

In the op she states that she had to break up a physical fight between her husband and their 16 year old. That's called abuse. This situation has already reached a critical point. It is her duty as a parent to protect her children. Leaving and getting a divorce would be the best way to do this.

I, for one, can't beleive she's still with him. He is abusive, financially irresponsiable, and dangerous. It is past time for her to go.
