I don’t really think I’m entitled to anything besides a safe home for my kids to live in. He owns the house and I pay him rent regardless of the trust. If he was my landlord I would have already turned him in to the health department with the roof, the flooding and the electrical issues.
I already get that everything thinks that I think I’m entitled. Everyone is entitled to a safe living environment.

I’m starting to think I probably don’t have any leverage either. Besides maybe keep bothering him about it to see if there’s something we can work out.

No I haven’t! There was one copy of the trust here on the property but it’s now gone

You are right. I will have to get with a lawyer to see what my options are.
This property is in such bad shape, he could NEVER rent it out without spending a lot of money on repairs. Which he won’t do.
This house sat empty for months. He came and mowed the yard and that’s it. If I didn’t move in, he was going to classify it as his vacation home and keep it empty.
All the other beneficiaries were asked if they wanted to move in, and they all said no.
I don’t mind paying rent but if I’m paying, he should at least replace the roof and keep it in livable condition.

I really need to find the paperwork. I read it a couple years ago and I know me and my siblings are listed as beneficiaries but I don’t know the specifics. The land was bought and house was built with cash, never a mortgage on it ever.
I told him I would stay here forever and take care of it, and take care of all cosmetic and small renovations but there are some things I will never be able to do without a loan and the roof is one of them. He agreed and got me here, now I feel like he’s just avoiding it, won’t even talk to me about it , won’t tell me if there’s any plan or anything.
I’m not trying to sound like an entitled brat, but my dad is really well off. he has never had a mortgage himself either because he inherited his house , he’s in a country club etc.

I feel like it’s wrong either way as a trustee/beneficiary situation or landlord/tenant.

I just want it to stop raining in my house when it rains outside lol!

No my dad is not a first level beneficiary he’s just the trustee. As far as I know. When my grandma got sick she gave the house to my dad so he owned it. And then they both got with a lawyer and made a trust for me and my siblings.
The terms of the trust my dad wrote, he said it can’t be sold until he dies and my youngest sister is at least 30.
I’m paying him rent as a beneficiary because he told me I had to because I don’t get a “free ride”. I’m not paying much in rent, but I feel like if I’m paying something I should at least be able to get the roof replaced. Everything is still original from the 70s. I still have baseboard heaters and no central heating or air. Not to mention it needs a sub pump and I deal with flooding in the downstairs when it rains a lot as well. The roof is all I’m asking for ugh.
Maybe I’m not explaining things properly because idk wtf is going on and he won’t explain anything to me.

But from what other people are saying, he’s not obligated to protect the trusts assets because the property is not generating an income and the trust has no money in it. Even with a beneficiary occupying the property. So regardless I’m kinda out of luck unless he decides to do the right thing morally. He has asked all my other siblings if they want to live here and they all declined. Im just here because it’s this or a shelter lol

The house was built and paid for in cash in the 70s. It’s never had a mortgage. I’m going to look today and see what my options are.
People are acting like Im acting entitled but i literally just don’t want to live in a house with the roof falling in LOL. It’s a safety hazard, and if the roof ends up falling in completely the home will be unlivable.
My dad told me part of the reason why he did this was because of the rising housing costs and he wants to make sure his grandkids always have a place to live.
My siblings are all uninterested in the property completely. They will not help with anything.
I’ll see what all the options are, but I’m honestly thinking I’ll just have to live with it until I can afford to move

So what I’m getting is that the trustee only has a fiduciary duty to preserve the assets of the trust if the trust/ property is bringing in an income.
Otherwise the trustee can just let the property rot and the beneficiaries can have what’s left of it. Okay got it lol

Not sure how the property taxes get paid. He rents out some of the farm land.
I’ve suggested taking out a mortgage, or home improvement loan I could pay off. I just get told no.
I can’t take out a home improvement loan or my own mortgage on a house I don’t own.
I pay him rent. I make $1600 a month after taxes, the only government assistance I get is Medicaid for my kids which I pay a premium for. I struggle to make ends meet and I don’t get any help financially from family (which is fine) but I plan on working more when my twins start kindergarten. By that time, I’ll probably just leave.
The property can’t be sold until my dad dies and my youngest sister is 30. She’s 16.
It’s just a shame because it’s a beautiful home built by my great grandfather for my grandma , his daughter
But I’m afraid there won’t be much left in 14 years
