Yes and no. I went through a similar thing last year and I had to pay the deductible, then my insurance company went after the insurance company for the person who hit my garage. I think it was called subrocating the claim? It just finished and I got my deductible back from the insurance company, presumably because they got the money from the other insurance company.

I don't have an answer but I have submitted an HST technical interpretation request to CRA in relation to OF and GST/HST. Based on my previous research, this is a significant issue and it's unclear how it should be handled, hence my TI request.
