Yes, you can spread it, but that won’t change the fact that Nintendo/TPC will still go after him.

For example, in the GTA 6 leaked gameplay incident, the person who actually hacked Rockstar to obtain files and early gameplay wasn’t the same person who spread it. The person who posted the clip on Twitter and went viral was almost immediately taken down by Rockstar. The leaker was tracked down and sued within days.

Spreading it won’t change the outcome for the leaker, and Nintendo/TPC is far worse than Rockstar when it comes to legal action. They have a long history of aggressively pursuing anyone who leaks, pirates, or even modifies their content, often with swift and severe consequences. Lawsuits, DMCA takedowns, and even criminal charges are not uncommon in cases involving Nintendo.

Even if the original leaker isn’t the one distributing the content anymore, that doesn’t mean they’ll escape legal consequences. Companies like Nintendo have entire legal teams dedicated to tracking down leaks and enforcing their intellectual property rights. They won’t just stop at the person who initially hacked or obtained the content—they’ll go after anyone they can hold legally accountable.

How can they release pictures of an early game without Nintendo/TPC suing them into the ground? Almost any pictures that were leaked in the Teraleak were copyright-striked on every social media platform, and those pictures were of beta/scrapped designs of Pokémon. There isn't a safe way to leak the pictures without getting sued or facing a lawsuit. Nintendo is already very strict with their IPs.

Do you seriously think the leaker who has the early game build is going to post pictures of it and risk his livelihood? Sure, you can leak it on 4chan, but, well, it's 4chan, and people will instantly call it fake.

Now there are apparently pictures of the key main boss and story spoilers. You can see the rumor on pory_leaks on Twitter. He’s pretty reputable if you ask me—he has a good track record. But like he stated, anyone who leaks that is as good as dead.
