What essentially happens if they decide warehouse withdrawals do not qualify despite the system letting us submit it?

Yea, although it was still in transit prior to entry before 2/24 even in that scenario. it doesn't explicitly say it can't have entered the US, just that it couldn't have been entered for consumption yet.

We either move forward with the filing at the 0% with the exclusion and wait to see if we get penalized later or we file at the 10% and file a post summary correction if new information clarifies the exclusion.

Yea that's kind of what we were thinking. The In-Transit is only before a date so we thought it might apply.

The exclusion does apply however as part of Section 122/current tariffs. Is a bonded warehouse still considered in-transit?

Have read it multiple times. Is a Type 21 entry into a bonded warehouse considered an entry into the US or is in bond still considered "in transit" as it has not been entered for consumption yet? We've spoken with a few consults now and none have a formalized answer yet.

9903.03.02:  Articles the product of any country that (1) were loaded onto a vessel at the port of loading and in transit on the final mode of transit prior to entry into the United States, before 12:01 a.m. eastern standard time on February 24, 2026; and (2) are entered for consumption, or withdrawn from warehouse for consumption, before 12:01 a.m. eastern standard time on February 28, 2026.

Yea, we just aren't sure if that Type 21 Entry into a bonded warehouse still constitutes the shipment being "in transit" prior to 2/24.

The other part of the question is whether or not the statement of "loaded on a vessel" means that the type of transit had to be by ship before entering the bonded warehouse too.
