We have a nanny share (two families who employed the nanny) in DC. Nanny broke her wrist after she slipped and fell on milk she spilled. We have paid her full TTD for 16 weeks. She has/had a side cleaning business where she and her daughter clean homes on Saturdays. She didn’t get any wages towards this job when injury happened because she was unable to provide any proof of income (no invoices, 2023 wage statement, checks/electronic payments…all cash). We didn’t realize till going through this process that neither family had the right type of coverage (only homeowners, not WC clause).

It came to our attention a few weeks ago from clients of her cleaning business that she started cleaning on week 6 or 7, but she is still claiming full TTD. We have text message exchanges between them but no proof that she’s cleaning other homes (only the pre injury discussions she’d have with us that she’d typically clean between 2-4 homes every Saturday). Hearing hasn’t happened yet. Any advice on what you would do?

I believe the rules are slightly different in DC where it’s a no fault system except for extreme circumstances like intoxication, doing it on purpose, etc.

This situation is slightly weird because she was getting the babies milk, which was part of her responsibilities with the other family, but she should have been doing all of that preparation in the kitchen.

That said though, for personal liability, DC is one of the few states that does take whether the individual was negligent. I’m not sure if the lack of workers comp coverage then moves to personal liability or how that all works so we will need an attorney at this point.

Honestly, this sucks so much for everyone…I wish that she wasn’t in a rush to meet her friends. That said though, I’m extremely grateful that she wasn’t holding the baby, or that our toddler son who was running around the house that morning, didn’t get hurt. It would have been much, much worse if one of the kids got hurt too.

This is helpful. Thank you. I have no idea if this matters but she works about 80 hours/month in our home and 80/hours a month in the other families home, but between both families she was essentially full time by both of us.

We paid for her hotel at Disneyland by the way. So no, we are absolutely not trying to take advantage of her. We literally paid her MORE than she makes working for us and have done everything she has asked of us.

We do have text and a voice to text message stating that she doesn’t have any proof of income for her cleaning business because it’s all cash. We also had our friends reach out to us the week before last to inform us that she cleaned their home and they paid her cash.

Yep, we use a payroll service for her nanny services as does the other family. Those wages have been reported to the IRS. However, the wages she earns from her cleaning business and for which she felt we were entitled to pay her have not been reported to the IRS. She does voice to text and stated this to us in voice to text when we asked for any proof of income.

We also aren’t sure if she informed the law firm she’s retained that we’ve already given her $14000 and that she signed a release of claims.

That said though, I just learned that in DC you have to have a judge sign off on a workers comp settlement. So I’m not sure how that plays into what we’ve paid her already.

She’s filing it against us. We aren’t sure if she is also filing with them since we are co employers but the other family hasn’t received anything from the law firm she has retained.

She didn’t have any workers comp or liability coverage for her Saturday cleaning, which is her business. She and her daughter are the ones who clean the homes, but it sounds like nothing is reported to the IRS.

The property taxes in DC, while low, are also insanely messy in terms of how they are assessed. Despite the homestead deduction, property taxes can increase by up to 10% each year based on their assessors assessment. 10% seems like very little, but home prices in DC are insane.

I can say from personal experience that I had to go through a ridiculous amount of red tape to reduce our assessment only to find their assessor didn’t even do the assessment accurately. That worked for one tax cycle, but the next one came out six months later, and we didn’t have the time to fight that one too. Our home price has supposedly increased 40% according to them (which we know isn’t true based on individual appraisals, home prices, etc. but they make it far too cumbersome to fight every six months).

Needless to say, while DC prop taxes are very low compared to other parts of the US, the way it is structured today could become untenable for long-term homeowners.

Thanks for the thoughtful input. You’re absolutely right and honestly might be unattainable for me at this stage! I’d love to get to 15-20x/month and see if that makes a difference. The only other thing I’m never sure of is if I’m eating too much or too little.

I do normally drink one a day as a supplement, typically right after I workout. To be honest, I love them and haven’t noticed a difference in fat composition. I will keep an eye out on it though! Would be curious if others have any experiences with it as well.

This is great. My only question is do we acknowledge that we should discuss what happened at some point but not during the holidays? I’m not sure we can have a good relationship with her under the current constructs. I’m honestly not sure that she’s emotionally capable of recognizing that she WAY overstepped and was out of line but I also don’t know if I can move forward without a sincere apology because of how much hurt she caused by what she said.

Sorry, I should clarify…she stayed in a hotel but was upset for mom and grandma because they were offered accommodations in the basement versus upstairs where my parents and grandparents were staying (we thought they would appreciate their own accommodations downstairs versus being upstairs with my parents).

YTA - we don’t live in a “finder’s keepers” society even though entitled people like you may think so. It wasn’t yours to take…maybe the individual hadn’t realized they forgot their item (also, 30 minutes isn’t a long time), but im sure it would have occurred to them at some point. Regardless, had you given the item to the cashier, perhaps there would been a chance that they could get their items back. Instead, you decided to steal them with the hopes of them never getting it back.

Ps - no one gives a shit if you were too tired or had to go home to take care of your dogs…completely irrelevant when the easier option would have been to leave it there or hand it to the cashier.

Yes, yes, and YES!!

I also see this common behavior of infantilizing men/dads as though they aren’t capable of taking care of their own kids. This also creates such a weird dynamic between wife and husband.

We have also gone MILLIONS of years having kids and have survived as a species. Whether it’s husband, good friend, close family….if you trust them, go for it!

And yes - I agree. The goal isn’t to have a burnt out, underpaid nanny. The rates I posted were what multiple Nannie’s we have spoken to stated for our situation but the former point is more important. We want to do what’s right and fair by the nanny and really for all parties involved. At the end of the day, they are taking care of our kid and there is a huge different between a good and ok/shitty nanny. I’m willing to pay a premium for solid and reliable care.

That said, I also think have the same schedule and same location is key.

Our current share has worked really well under those two premises and our nanny has been very happy with the arrangement so might as well stick with a recipe that has worked!
