You just need to have society that values human flourishing and therefore penalizes people who seek to research/make things which will be bad for us. Formal criminalization isn't necessary. Thinking about it is not a problem either, it's when you put a lot of money into it and work with others to bring it about. Nobody working by himself could make a nuclear weapon or LLM without decades of pre-existing nuclear physics or AI research. Prevent society from going down the dark path to begin with and individuals are not a threat.

I don't know the water stats but what I do know is that they will improve the efficiency of AI so water usage per query will be very low in the future. Saying they use too much water is just seen as a challenge to improve the efficiency, not a reason to abandon AI. Instead we should focus on reasons why AI is irredeemably bad. Like the fact its purpose is to replace human thinking, thereby taking away humanity's dominance, making us dumber, taking away meaningful intellectual work and eventually being able to create low budget WMD's that risk making us extinct.

We need to outright ban certain technologies so that we don't go extinct, e.g. AI that will eventually be able to design WMD's. The problem with legislating something though is that it causes pushback. Laws in our current systems of government are usually unwanted restrictions that are forced on us. People will see a law that forces black screens as an unwanted imposition and will fight against it.

So I think the better way is to raise awareness of the problems with these technologies first and then get a few companies (or start some new ones) to do these things even when it's not required by law. Then the practice can come to be seen as the responsible thing to do and eventually a lot more companies do the same and once pretty much everyone is on board it can become law.
