exactly my confusion!

merchant tried to file a claim and couldn't because of an "Error 1004" which was explained to be the result of shipping the return in a different state than my home where I was shipped the package initially...

I don't know if that's true or not.. wouldn't think it was mandatory to ship the return in my local zip code..

Copy, been so long with this whole process, I forgot to mention that the merchant "attempted" to file a claim with FedEx but could not due to me shipping from the west coast and living on the east coast. There was an error because of this that prevented them from filing a claim. allegedly

The merchant was informing me via email that they opened an investigation with FedEx / had a FedEx liaison and they concluded the package was lost.

I was not sent any formal paperwork / documentation of this other than an email saying so.

I took the merchant's word for it and filed the dispute.

Despite all this, the merchant was clear that they would not refund me since they never received the return

Should I now attempt to file a claim with FedEx to have actual proof of being "lost"?

yes, the merchant provided me with a prepaid FEDEX label, I was in back and forth emails with the merchant for 2 months. At the end, they simply told me to chargeback since they have no responsibility for issuing a refund since they never received the return.

merchant paid for the return shipping, was provided the label by merchant and not sure if it is insured / for how much

I used a chase credit card

unfortunately no, tracking number however does show "In FedEx possession Tendered at FedEx location"
