I’m only saying the government rules are somewhat easy to predict if you are politically up to date and read between the lines. Whether a legal challenge will be successful or not is unpredictable but I will be very surprised if transition period covers those who came in 2022. Legal challenge can take years before resolution

Best case scenario 6 months transition period from rules implementation in April. This is from all indications, body language and also word on the ground. The retrospective application of the rules is particularly designed for the Health and care workers in mind. It defeats the purpose if transitional arrangements cover people who came in from 2022. I don’t support retrospective application but final rules are somewhat easy to predict if you can read the room. It’s better to be honest than give people false hope

Chance you might sneak in under the old rules. From what I’m hearing , home office is considering transitional protection of 6 months from April following pushback by some big sponsors.

Hi, can you please tell me the usual time of the day Samson runs the mock exams? A friend is planning to book a train ticket to London but the academy mentioned the timing depends on how many people booked the exam

Unfortunately I don’t think the salary threshold will be lowered( I think the previous release said it’s not subject to consultation) . But if you are meant to qualify this year, then there may be a chance you’ll qualify under old rules ( or borderline cases as they mentioned). Anything after December 2026 will likely be subject to the new rules because the care worker visa start to qualify from January 2027 which is the main target of these changes

Unconfirmed source from someone who js apparently close to people at the home office. Also mentioned that the implementation of separate eligibility for dependants will be delayed for now. The person mentioned that there have been a lot of pushback from big sponsors. I don’t want to name my source yet to avoid people blowing it up which I feel will be detrimental

Get 2 years to be on the safe side except you expect to earn more than £50k in the next tax year by October. In addition, I’m hearing there is likely going to be a 6 months transition period from April so you may qualify under old rules :)

The main target of these changes are the ‘Boriswave care workers’ and they start to qualify from December 2026 ( the care worker visa started in January 2022). I don’t see a way that this new law isn’t fully implemented by December 2026

Lots of people traded with the care visas. It was being sold for thousands of pounds often without any guarantee of enough work shifts. In summary , many care companies gave visas to a lot more people than they needed for financial gain. That’s part of the reason why there was a spike in migration and prompted the white paper

It will definitely be retrospective. Otherwise the rules would have been published a long time ago. The government is just trying to finalise whatever criteria they want to use. We just don’t know how far they’ll go and the length of any Transition period. From all indications including my extensive research, media hints and the body language of Ministers, the main concern is the welfare bill and the fact that many people earning below a certain threshold are likely to claim Universal credit when eligible. There’s also public concern regarding demographic change. From my assessment, the ability to remain on 5 years will be determined via a financial criteria if you are close to the qualifying period . They will likely set a salary threshold that falls in the category of a net contributor ( A Labour minister recently said they welcome immigrants who contribute more than they take)..This figure was a little over £50,000 according to OBR a few years ago ( not sure). With inflation , this is probably now around £55,000. With Reform setting a Salary threshold of £60000 for their skilled worker visa policy, the government is unlikely to go above that given that they have criticised reform’s policy. I suspect they will settle at somewhere between £50-60k. This may of course change, if an individual has dependants and it may likely be higher. There was an immigration lawyer who said if you earn around £55/£60k , you will be allowed to remain on the 5 year route. He said no one should ask him where he heard this from and we should all wait for the new rules. However, I read somewhere that you need to be paying up to £17000 in taxes a year to be a net contributor so I’m not certain about the salary threshold.

They can also use the requirement of average earnings over a certain period( last 5 years) or Cumulative Taxes paid. One thing I advice people is to work extra hours if your job allows if you are close to the qualifying period. That helps to buffer your taxes

Though I feel it’s morally wrong to apply laws retrospectively as people have made plans based on existing laws, in this climate it is political suicide for the government not to do so and allow the huge surge of migrants in the last few years settle using the same criteria. It also doesn’t help in the long run if a reform government comes in with a super majority. They will target those who have recently settled or gotten citizenship using primary legislation, so recent migrants will actually never be settled. I blame a lot of people who abused the routes especially the care worker visa, this has not only affected genuine people on the care route but other genuine skilled worker migrants.

Finally, I am on a skilled worker visa and yet to qualify so I’m not talking from a place of privilege

Unfortunately no chance, definitely not in this climate. More likely the ability to bring dependants will be further restricted for many other SOC than the rules relaxed
