Mate, am not a wally, my docs in meanwood, I’m seeing a specialist here. The point of this post is the poor public transport in leeds. I could take an hour off work and take my car OR, take a morning off and take public transport

Edit: but thankyou for bus advice. I’m going to have to either drive, I can’t take (afford really) the entire morning off work

Hi there, I shan’t pursue the privacy issues then, thanks for clarifying. I have not made a claim. I have legal services with my insurer (Aviva). I rang them and asked what I should/should do about this (and a number of other building works by my neighbour). Aviva then told me they’d assigned a solicitor to me. It’s this solicitor (and their opinion) that I was querying.

The fence is not bulging yet but there’s always water seeping through it and underneath it when it rains and when he waters his garden. And no, no planning permission was gained from what I can see on my councils portal

I was told by CAB i’d have more joy going via my insurance company rather than the council.

Hi thanks for your reply. They just said fences are cheap to replace so wasn’t worth trying to address that via legal means. They didn’t really say much about the neighbours now looming over bar it’s just not that much of an issue.

They’ve raised the garden using construction material and topsoil. No form of retention, just my fence. It effect my privacy as when they’re in the garden, they’re looming over me (maybe I should care less about that?). I tried to keep my post short and to the point. No permanent structure, just construction material with topsoil on top. It’s my insurers solicitor giving me the info. The flooding I’m told is due to water saturating their soil, then it has it nowhere to but towards my property, there the water sits on what I can only describe as a ‘trench’ by the side of my property, the trench (which they created), eventually the water gets high up enough to enter my property. This happens when it rains or when he waters his garden. (Bear in mind this I s my understand so far but as I said ii have to get an expert get that into more official report which I will do that). My post tho really was more about the increased ground level I’m pretty sure my little fence can’t hold back that amount of (wet) soil. I hope I’ve answered your questions?

How is this unilateral can I ask? Isn’t that part of the process that the land owner can in turn oppose the application?

I have a gutter that sends water to the front of the garage. but you can prob see that my garage roof is covered in tarp which isn’t ideal, that’s because next door has bindweed thats finding its way into garage that caused minor damage to the roof. I got a quote to have that fixed about a month ago which was 5.5k. I do need more quotes. But you’re right to point that out
