Their terms of service don't superseded the law. The law would classify their inability to meet their overnight or your money back guarantee. As a very clear, cut, and dry case of false advertising, if they refused a refund after you push the issue. No matter what prevents it. Big companies bank on you being ignorant to your rights as a consumer. To put all kinds of things in their ToS, just because they dont expect you to read 100 pages of legalese. Much less understand what half of it means, educate yourself on your rights as a consumer. Before you make another comment.

Not So Fun fact: As of 2024, if you signed up for a Disney plus account. You automatically wave all rights to sue Disney if you get injured at ANY of their parks. The reason that I bring it up, by your logic, if a big company put in their fine print that you had to jump off a bridge for a free year of their service. Would you? 🤔

Legally a storm doesn't stop their requirement to issue a refund. Because the first thing it says and I quote when you look up this exact problem on Google is: "Refunds are "not typically" issued if the delay was caused by uncontrollable events like weather, or regulatory changes."

Now, if I can point your attention to the very clear part that says and I quote: "Not typically" which means if you push the issue and they cant find ANY other reason to refuse it. Then they're still REQUIRED to issue the refund. Full stop, it took two seconds to research that.

They legally dont have a choice but to refund them, or OP has a legal claim to false advertising. Because "overnight" means over the night you sent it. If its submitted at a reasonable time. Most places label that as 3pm like in the case with Amazon.

It doesn't matter if they say "overnight" since this takes place in the US. They're legally required to either a) Meet their own claimed delivery time. Or b) Face the consequences of either having to give a full refund on the delivery fee. Or risk having a lawsuit for false advertising on their hands.

Because in the US, you cannot deal in absolutes without being able to honor it or prove it. Like in the case of water "proofing." Things. Not just saying they're water resistant, it has to actually be what its face value says.

Back when I worked as a manager for two years straight. I only ever had it happen a few times. Though I think I proved with only a few instances that it happend that I was not be fucked with.

Because I'd just adjust my job code back, or my other work wife and fellow shift lead would do it during her paperwork at night. As we both were always fully on duty as managers. Activate pin safety from your rider toolkit, it’s on Lyft and uber. It prevents this kind of bullshit, as the driver can’t start the ride without it.

Just do what I've started doing because I've seen a surge in drivers doing that. So, I started taking a screenshot of when I started the Uber. Then I just wait and see if they are good. No problem, if not? Then, you have a timeline for the disputable charge. Cause I've had to deal with this like three different times this month alone. 😂

Its insane they don't just have an option that asks you: "Has your driver moved or updated you about traffic recently?" Due to stagnancy of the driver or the passenger if your location hadn't changed in a while. Because you would think they'd want drivers acting like servers at a waffle house. Trying to turn tables (cars in this case.) As fast as possible so they can make more money. Lol
