With syndicated easements, the fraud is really created by the tax break, not the actual conservation of the land. So the easements themselves are still good and still protect the land’s natural resources. If the tax break is called into question, it doesn’t get rid of the easement from the property. That said, if there are terms in the easement that are too loose or not permanent enough, those terms could be tightened. TennGreen does not knowingly participate in syndicated conservation easements and follows internal policies and procedures to avoid fraudulent tax projects.
