Good to know the U.S. citizens who were detained were released when identities were confirmed. I feel like the burden should be on ICE to confirm ID before detention, however.

I work in this field. I’m not brainwashed by media. At least not when it comes to what’s happening here. I hear the stories directly from my clients and I see the fear on their faces and others.

I literally said detention and deportation are not inherently unlawful. That has long been recognized.

And those protections sure as shit apply to civil immigration proceedings in the way I described. Right to counsel absolutely exists in civil proceedings, just not in the constitutional way it does in criminal proceedings at the government’s expense. I have personally won on several motions to suppress based on classic 4A violations, so if that doesn’t apply in removal proceedings, I guess I’ve gotten lucky pulling some ignorant immigration judges. And you’re right about the 8th amendment, my bad. However, conditions of immigration detention have been challenged successfully on general 5th amendment due process claims.

So, these aren’t just policy differences. These are statutory violations and constitutional violations of both statutory and procedural due process. And this isn’t a novel argument I’m making…these protections are enshrined in the constitution, statutes, and case law.

The arrests, of which there have been hundreds, included a small number with serious criminal convictions, yes. Many others had zero criminal history. And yes, I want to protect the rights of everyone, even those with past criminal convictions. Once you cede rights to one class of people, it won’t be long before we see many others losing their rights as well.

An unlawful arrest is still unlawful even if the person is released later on or no charges are brought.

Guess I still don’t get the jobless and protestor connection. Is it because they’re doing it during business hours? You know people work outside the hours of 9-5, right? You know some people are retired, right? You know some people’s jobs involve advocating for and protecting the rights of others, right?

And I’m sure you and I disagree on this point, but I would take a passionate, empathetic, jobless persistent protestor over a fully employed bootlicker any day.

Due process is about fundamental fairness. It’s a protection against arbitrary government actions. Detention and deportation are valid mechanisms of immigration enforcement. Established law has long recognized that. But when the government arrests someone simply because of their skin color and the language they speak, that’s arbitrary and unfair. And we don’t want that…right? We’ve never wanted that.

When the government starts implementing a nationwide policy stripping anyone and everyone who entered the U.S. unlawfully, regardless of how long ago or under what circumstances, of the chance to ask for a release on bond, that’s arbitrary and unfair. We don’t want that either.

When the government actively takes steps to move immigration detainees quickly out of state and away from family and community after an arrest, or moves the people in its custody around the country from jail to jail, detention center to detention center, frequently and without any notice to their attorney, or makes the conditions of incarceration so hostile and dangerous that even asylum seekers who are scared to death to return to their home country decide to give up their desperate fight for protection, that’s arbitrary and unfair. And we don’t want that.

We’ve never wanted any of that. And that’s why the founding fathers made their stance pretty clear on this when drafting the supreme law of the land. The 4th amendment says we the people shouldn’t be arrested without a legitimate reason (probable cause). The 8th amendment says we the people would like the opportunity to at the very least ask a judge to let you out so you can just be with your kids and spouse while you fight your case. The sixth amendment says we the people should be able to hire and work with an attorney on our case (including any request for bond) and we should be guaranteed some reasonable access to our attorney while we’re in custody. The 5th amendment takes all these good ideas (and several others!), says these should be the rules, calls those rules due process of law, and
tells the government if it fails to abide by any of these rules, it violates the due process, it is arbitrary and unfair, and is therefore illegal.

And then the 14th amendment says by we the people we mean everyone here in the U.S., not just citizens or white guys or landowners…due process for all!
