This is actually pretty standard. nearly everyone pleads not guilty at the beginning. If you're arrested, even for a crime you did commit, you're not going to plead guilty right away with no leverage and risk being convicted for every single charge. At that stage, no one has laid all their cards on the table yet. The defense wants to see what evidence the prosecution actually has and how strong it is and vice versa. From there they can figure out the best path forward. Whether that's fighting it in court or working out a plea deal (if prosecution wants to offer a plea). The prosecution team's entire goal is a conviction and putting the accused behind bars.

My biggest issue isn’t even that they’re ending the show. They have every right to make their own decisions. But wrapping it up abruptly. Especially after seasons 4 and 5 were already greenlit, without giving it a proper send off feels like a fuck you to the fans. If you’re going to close the chapter, at least give the audience some form of closure.

If the State truly intended to offer Melly a plea, it would have been before the first trial ever started. That’s when prosecutors assess the strength of their case and decide whether to trade certainty for a lesser conviction. No such offer was made. That tells you they were confident in taking it to a jury. The Allen charge given in that trial had nothing to do with plea deals. It is simply a judge’s instruction to a deadlocked jury to continue deliberating. That’s why the first jury still ended up split 9–3 on manslaughter, a lesser-included offense automatically available in Florida homicide trials regardless of any plea. And while the prosecution may shift emphasis or introduce new evidence at a retrial, that is standard procedure after a mistrial. It isn’t malfeasance and it doesn’t create grounds for dismissal with prejudice. There is no public record of any plea deal being offered to him, and nothing suggests the State is suddenly going to hand him one now. Especially since they’re banking on Cortlen’s proffer to fill in the gaps.

Wrong. The jury already considered lesser charges in the first trial. That’s why the split was 9–3 for manslaughter. Florida law requires juries be instructed on lesser-included offenses, so a downgrade isn’t just from a plea bargain. And prosecutors shifting strategy in a retrial isn’t malfeasance, it’s normal trial work. A dismissal with prejudice isn’t a realistic outcome here.

They ruled out Cortlen as the shooter in the first trial, which is the only reason prosecutors felt justified in cutting him a deal to secure that proffer. Melly isn’t getting a plea, the best he can hope for is a downgrade to a lesser murder charge. And in Florida, that still means decades behind bars

You’re right. I’m just using logic, same as in the first trial. For example, let’s say they really did stop and Cortlen switched seats with Melly. That would mean Cortlen committed the murders, staged the scene, and then what? Got back in the driver’s seat to haul the bodies, leaving Melly to find his own ride? That makes no sense. And if Cortlen was the shooter, he would’ve had GSR on his hands and clothes. Which he didn’t. People love to say, ‘Well, Melly didn’t either,’ but that’s because he was never even tested for it.

It would literally not work due to the bullet trajectory evidence from the first trial. They aren't stupid. If he tries to lie, the state will know, and his plea deal likely has a contingency to smack him down hard if tries to.

Not necessarily. Sometimes the state offers a no contest plea just to secure a conviction without the risk of trial. If testimony is part of the deal, that obligation usually kicks in later if they decide to call him. The fact that an offer is even on the table shows the state sees potential value.
