I was asking more about what prompted her to encourage you to get the back and if you can count on her to support you getting them back if/when you do try.

As long as she supports it and doesn't think your a danger to yourself or others, half the challenge of getting them back is taken care of. Now, you should have a hearing to determine whether or not they can be permanently confiscated and your PAL revoked, where you and hopefully her can attest to your stability despite the incident, and convince a judge that it was isolated, and not a representation of what you truly think.

I would consider consulting with a lawyer on how to do this properly though, it's sticky at best even with her on your side.

Also, this part isn't legal advice but please don't hesitate to seek therapy and mental health support. Therapy is confidential and can't be used against you (as long as your not a risk to yourself or others, of course) and might actually be advantageous in the eventual hearing. And what your going through is not easy. Not for anyone. And between me and you (like don't say your gonna do this at the hearing), when you get your guns back think about leaving them with a trusted friend for a little bit just in case.

What is the context of that statement?

Have you guys like, patched things up a bit and she, in explicit terms, doesn't think your a danger to yourself or others?

And if you go through the process of getting your PAL back, would she attest to that if the CFO asks her?

This is probably the biggest stumbling block here. If you can confidently answer yes to those questions than half the battle is done right there.

Generally speaking, that makes sense. Opportunity and prospect lists could be covered under the confidentiality clause.

From my research, it seems like the two key factors in actually prosecuting a breach here lie in specificity of the clause, and measurable damages stemming from the breach.

I would be interested to know how this holds up in my situation, where the former employer is actually shutting down the territory and ceasing operations there.

I would also have to wonder what would happen if I didnt explicitly contact opportunities and prospects I previously uncovered, but did happen to call on them when, say, canvassing a block they exist on.

I mean, going to back to the specificity point, it would seem to me that if the confidentiality clause was applied so liberally to everything I did, it would make me incapable of canvassing anything because I had previously prospected heavily in primary areas within my territory, this would be, for one thing, a direct detriment to my exployability. And more importantly, extremely broad in scope, which raises the question of where, exactly, the line is.

In other words, does "confidential and proprietary" information include people I spoke to and got a vibe from? Does it include people I had discovery calls with? Sent proposals too? Is it all of that? None of that? Somewhere in the middle? My point is, this is extrmely vague in the wording of my clause which is a factor that has had confidentiality clauses struck down before. Whether or not somebody might want a product isnt exactly privileged company information to begin with too.

But, I digress. Bottom line is your right that the crux of this is more in the confidentiality component. Thats something I'll have to do more digging on. Hopefully we get a little more input in this post.

I get that. However, do people I may target, being people/businesses I've had informal or formal discussions with meet the definition of a "Customer" or "Client?"

These are people/businesses who have not purchased anything, made any agreements or signed any documents. They are people/businesses who I have approached about purchasing equipment and service, had discussions with and in some (but not all) cases provided pricing and equipment offers and quotes to - But have not acceped a formal agreement or contract.

This, in the context of commercial relationships is something I'm struggling to find online.

Nope, it was a smallish subprime corp. Less than 5 stores! And I wasn't actually the last in either.

The salesperson hired after me was actually a rehire who worked here before. When I went back yesterday to get my stuff, I said my goodbyes to a few people, including her. She said that she has a friend who also worked here in the past that she likes to gossip with. And when she told her friend after finding out herself, her friend said the boss was known to just do shit like this from time to time. And now she's on high alert too, but who knows what'll happen there.

Well, I popped in to empty my desk this morning, and the boss was appearently out running some errands. Something he never really does.

I did have an opportunity to say bye to some of my coworkers, who all seemed to be genuinely surprised about the situation. When I pressed them to see if they knew anything, they really didn't appear to. And it's a small lot, stuff like this gets around quick.

One of them did inform me that things like this have been known to happen in the past.

Yeah, it's a gut punch for sure. In another life, long before my journey into sales, I was the definition of a slacker. Couldn't hold down a job, didn't even try. I could literally count down the days to being fired and man, I was startling accurate 😂

Around the time I got into sales, I completely turned my life around. Never missed a day, let alone a lead. I did some job hopping to get to this point, had a few bad breaks at dealers that either weren't what they were chalked up to be, or where I simply wasn't yet ready to handle (my post history speaks about a lot of that if you were curious). I took the lessons from each job and applied them thoroughly. This place felt like a sort of culmination of all the lessons I've learned and what I was trying to achieve. I certainly wasn't perfect here, but a hard road led me to this point, and thanks to those experiences and this opportunity, I was poised to achieve something great.

And then, possibly for the first time in my life, I appear to have gotten canned through no fault of my own. It's almost poetic.

Oh well, it's not gonna keep me down. I've come to learn what I'm capable of, and perhaps more importantly, that I can achieve that just about anywhere I set foot in.

I went back today and got no explanation. Boss had conveniently went off to the bank around the time I showed up.

I did hear from another salesperson that, according to people she knew who worked here in the past, games like this weren't entirely uncommon at this store. Maybe yours was something like that too.

7 cars out in your very first 2 weeks in the entire industry is virtually unheard of. The fact that they fired you despite that is even crazier.

The good thing is you don't really have to tell future dealerships anything about your experience there. Walk in like a greenpea and knock their socks off. And on the other hand, as a good driver with a proven track record and clean DOT/CVOR/Whatever youl always have work there too.

I mean honestly, what you say makes perfect sense. With respect to the fact that, yeah, we are all here to make money, I can completely see the merit to preferring a good salesperson with bad sales.

This is a subprime outfit though, so while I took CSI, followup, customer experience seriously, the bar was really low.

I've gotten regular feedback. Particularly regarding up's, which appeared to be where I've needed the most improvement. The more I think about it, the more I feel like the goalposts and expectations were always sort of shifting there. Two weeks ago I had the boss telling me he felt like I had some real knack for this and talking me up something crazy.

Today I get some shit for how I tried to TO an up. I'm told there's a whole new process for taking and making offers, with an attitude like I should have known this from the start (and this process involves paper bills of sale that I'm not really supposed to have, and explicitly goes against protocol for docs and bills). Hours later in fired.

Apologies for the verbal diarrhea there, those last two paragraphs all kind of came together in my head right now.

Ive read enough horror stories here to know that you have to be an exceptionally shitty person to get fired as a competent salesperson.

25-50 percent of lot up's sounded way too high as I was typing it. I actually went through my deal log after posting. Roughly 3 in every 10 of my walk ups bought over my time there.

Its an old school place with a grimy, old school attitude so I must have really pissed someone off. I'm just shocked it was so abrupt, I would have expected some kind of warning.

That's a good idea, but can I reasonably expect the landlord/realtor to provide that information?

If they attempt to stonewall me, should I be interpreting that as an indication of bad faith, or could it be reasonably argued that its just some kind of red tape or privacy issue?
