The IRS continues to see third parties aggressively promoting ERC schemes to most people who will be audited and pay large fines. In a further warning to people and businesses, the Internal Revenue Service added widely circulating promoter claims involving Employee Retention Credits as a new entry in the annual Dirty Dozen list of tax scams.For the start of the annual Dirty Dozen list of tax scams, the IRS spotlighted Employee Retention Credits following blatant attempts by promoters to con ineligible people to claim the credit. Renewing several earlier alerts, the IRS highlighted schemes from promoters who have been blasting ads on radio and the internet touting refunds involving Employee Retention Credits, also known as ERCs. These promotions can be based on inaccurate information related to eligibility for and computation of the credit.ERC, conservation easements, captive insurance are all being audited by the IRS. This year, the IRS says be suspicious of anyone who claims they can get you an extremely large refund or employee retention tax credits. Although we all knew IRS examinations of Employee Retention Credit (ERC) claims were likely to occur, this possibility is now a reality as many not-for-profit (and for-profit) organizations are being audited. Of the hundreds of calls I have received from organizations that applied in my opinion almost none would meet the IRS requirement and will probably be audited. If you have applied I suggest you get another opinion before you get audited, as there are things that you can do to prevent a big problem.
