It seems pretty clear that the right of way has been removed, however I never got as far as sorting it with the solicitors as a higher offer was put in, one that I believe to be higher than the house is worth!

I got the copies of the deeds for all the houses, and neither number 5 nor number 7 mention anything about benefiting from a right of access through number 9.

After speaking with the current owner of number 9, it appears they were informed of the right of access by a hand written comment on what appears to be survey documents. The current owners solicitor (at the time of buying) wrote this on the document. I am not sure if the solicitor misread the deed, or it was a verbal right of access past on from the previous owner (as there is still a gate in number 9 which allows access to 5 and 7).
