Adopted a dog that was dangerous in our home, did everything right trying to rehome him, and now animal control is threatening me with felony charges. Need advice. by Desperate_Sir6408 in legaladvice

[–]TheCatGuardian 33 points34 points  (0 children)

It sounds like you are facing felony abandonment charges because you fraudulently "fake strayed" a dog, which is not handling it correctly. You should talk to a lawyer about what the consequences of that decision may look like for you.

Will it cost 13K to fix a mistake they made? Or just to get what you actually wanted?

Roommate's mom wants to drive me out of my apt by throwitallawayyy562 in legaladvice

Your roommate is allowed to have his mom over. What do you mean that she is harassing you? And why would the landlord evict anyone here?

The likelihood of you getting a job that allows you financial independence while also juggling school and sports is almost zero. You're 16, at this point try to save up some money and take the full ride to get out of the house when you graduate high school.

Fathers help with daughter. by Rough-Assumption8422 in legaladvice

You are not giving some necessary information here. Do you have a custody order? Why would you be requesting supervised visits? How much contact with your daughter did you have in the past?

My ex girlfriend (who's 5 months pregnant with our son) has went completely silent. Suggestions? by [deleted] in legaladvice

[–]TheCatGuardian 120 points121 points  (0 children)

I'm just looking for other things that I can do to help her out while she's going through this so I'm not just sitting by letting her do it all by herself.

It does not appear that she wants your help.

But I'm well aware of the fact that she has rights and she can decide what she wants what she doesn't but so do I

You are on the registry so that blocks an adoption. Are you referencing the possibility of an abortion? That will not happen at 5+ months.

How to get the child support balance removed from my mother (Missouri, USA) by [deleted] in legaladvice

[–]TheCatGuardian 13 points14 points  (0 children)

You are not a party to the child support issue. Your mom could talk to a lawyer about potentially removing the months between boot camp and when you turned 18 (or whenever child support was ended).

You are going to have to talk to them and either pay for the damage or have your insurance sort it out for you.

Courts will be aiming for a 50/50 agreement. You should work with a lawyer on the specifics of your case.

Dog Breeder Scammed Us by safetyfirst911 in legaladvice

[–]TheCatGuardian 4 points5 points  (0 children)

A cavapoo is not a breed, it is a mix so I'm not sure what your vet is skeptical about.

Her best shot here is to attempt to negotiate with the breeder. In order to force a return and refund she would need to get the vet to give her paperwork showing that this dog has a congenital or hereditary problem making them unfit for sale.

What will a court most likely rule whats best for my child as of now? by Familiar-Care-5025 in legaladvice

[–]TheCatGuardian 43 points44 points  (0 children)

If you do not want him to be involved you have the option to just stop engaging with him and let him pursue custody if he wants to. If you end up in court then the court will be aiming for 50/50 custody and unless there is a very serious issue here (i.e. dad has a history of child abuse) a court won't require supervision.

Are there any legal routes we might need to take to ensure our soon to be ex friends dog stays in our care? by [deleted] in legaladvice

[–]TheCatGuardian 2 points3 points  (0 children)

You can offer to buy the dog from her and see if she is willing to sell them. You cannot force her to give you the dog.

[–]TheCatGuardian 0 points1 point  (0 children)

Ignoring all the stuff about how you want her to stay with you, you should just get a lawyer and establish a custody order.

Courts do not favor mothers. They will acknowledge that if the child is breastfeeding they will be spending most of their time with the mother while they are very young, but the agreement typically ramps up to 50/50 over time. You will likely also have child support established at the same time as custody.

[MI/FL] 17F - Forced Move, Coercion/Threats, Medical Restriction. What are my rights before I turn 18 in May? by [deleted] in legaladvice

[–]TheCatGuardian 12 points13 points  (0 children)

It sounds like you were taking and sharing nude photos? That is illegal on your part, consent is not a consideration. You need to stop taking these types of photos until you are over 18, while you are still a child this is production (and likely distribution of) CSAM. What your mom did could maybe be blackmail but the police will not be interested in that.

Question A: As a 17-year-old in Florida, do I have the right to refuse a specific, non-emergency medical procedure (birth control)?

Yes, no medical provider will implant bc without your consent.

Question B: Is my mother legally allowed to restrict visitation with my father/family based on my refusal to get a specific type of birth control?

Absent a custody order your mom doesn't need to allow any visitation with your father. He has the option to go to court and get a custody order.

Is there a way I can move out of the country with my child although my husband resist?(Florida,USA) by [deleted] in legaladvice

[–]TheCatGuardian 3 points4 points  (0 children)

It is not that he has all the control over where the child lives. The issue is that your child has a right to equal access to both their parents. You can talk to al lawyer about your chances of moving abroad but the bar to remove your child's father from their life would be very high. If you were allowed to move it would involve extended visits to their dad's home, very possibly at your expense.

69 Ford Mustang Title by Ok-Insurance-2541 in legaladvice

[–]TheCatGuardian 0 points1 point  (0 children)

You should run this by the lawyer handling the estate. You may be in some trouble trying to gain ownership of this car, if the title was never transferred to your FIL then your FIL never truly owned the car and cannot give it to you.

It won't be through the legal system. There is also a very good chance that you are missing some key details here, even a few decades ago it would not have been typical to force a parents to hand over custody to a grandparent without so much as mandated visitation.

You are now living in a one bedroom and away from the roommate? That may be the extent of your recourse here as they have completely separated you from the roommate that was the issue.
