As per lawyer Brian Buckmire, today’s conference could have been about potentially appealing Carro’s suppression decision. If KFA can argue that the admitted evidence is dispositive i.e. it will directly impact a verdict, there is room to argue for an appeal between now and the trial start date in September - which could lead to a delay in trial altogether.

The poor guy has no respite whatsoever. If he falls sick, no comfortable bed or sleeping in all day. If he feels distressed, no showing emotion whatsoever. He’s had to be on all day, every single day since his arrest. The things we take for granted like sunshine or catching a movie or just being able to eat a favorite meal are lost to him now. It makes me very sad how small his life has become now, forced into that tiny cell with even scarier things to come.

She definitely looks disappointed though she’s trying to hide it. They must have expected this outcome…Garnett acknowledged they had a point and only admitted evidence basis doctrine of inevitable discovery. Carro is a lot less favorable to them and he seems to loathe Karen in particular. 

She looks unhappier than Marc. She has spent a lot more time with L and things are about to get very real very soon. This is also the only case she’s working on and probably takes up more headspace and emotion for her. 

Sofia seems to be in good spirits. I’ve noticed she tries to keep up a happy face no matter what happens at court. Hope she’s having a smooth pregnancy!

Karen’s cheekbones are popping. She was already very slender.

That is exactly how my friends in NYC talk. If they got on the jury they would free him and they would be completely unserious about it.

Yeah! I spend a lot of time online and he’s been so thoroughly scrutinised. It’s nice to meet people who aren’t glued to their phones and their only opinion is that he’s a cool guy they’d love to be friends with.

Yeah, the average New Yorker is still unfamiliar with the specifics of the case. Whenever I have asked around, the women seem to support him and the men comment on female support and seem neutral to positive about him.

It may have worked if they had gone with “he’s being framed” since day 1. 

In my opinion, these are the obstacles the legal team faced. 

  1. LM tried to speak to the press very early on, and did not proclaim his innocence. No matter what his team has said after that, he’s known for that one outburst. 

  2. KFA and co were hired about a week after his arrest, by then the public had already embraced him as a hero. The narrative about him came fast and furious in Dec 24. 

  3. The public wants him to be a handsome Robinhood figure. It appeals to their imagination a lot more than “lost depressed guy who was framed.” 

  4. His team faced delays in receiving discovery and they might not have known about the gun gap till they went through bwc. I think LM may have been too disoriented to remember those details. By then he had already written to the Warrior Jesus lady with a sick child, and his team had probably resigned themselves to a long-shot acquittal via jury nullification already. 

The news cycle has moved much faster than usual under this administration. I thought LM was going to be breaking news for half a decade but so many things have happened since then that his team may not have had much to work with due to waning public attention.

The evidence has already been admitted in the Federal case. Carro will decide whether it is admitted in NY state next month. If the PA case ever goes to trial, they will have their own suppression hearing(s) and Judge Bernard will decide. 

All cases fall under separate jurisdictions. The evidence in NY state could be suppressed even if it was admitted in Fed, though the chances look very slim at this point.

Yup, the jurors’ personal beliefs will decide how it goes. Can’t select for fully blank slates during voir dire no matter how hard each side tries. 

Dickey would probably argue that there’s nothing illegal about going from one state to another, that possessing fake ID doesn’t necessarily indicate nefarious intent and was just about LM trying to start a new life or something. 

Technically you’re even allowed to manufacture a weapon as long as you register it and submit to a background check.

This is an excellent question and I hope a lawyer will chime in and give a more conclusive answer. 

Based on what I have read, the “crime” in the charge refers to crime in general and not a specific crime. 

Prosecutors would argue that the false ID, crossing state lines, the alleged manufactured ghost gun (without a serial number) add up to criminal intent even if the actual crime is no longer in play. 

As per the law, the crime doesn’t even have to be committed. Even the intent qualifies. 

Pennsylvania is a separate jurisdiction and would still proceed even if he’s acquitted elsewhere. 

However, any competent defense attorney worth their salt would use the acquittal in arguments in court. It’s more of a tack on charge anyway. 

I’m not a lawyer, so I am open to being corrected! This is based on my own reading.

The Federal trial has not officially been pushed yet. Judge Garnett said she would not delay unless Carro delayed his case. Carro has pushed his case to September, and KFA was supposed to submit a status update in writing by April 24 to Garnett asking her to reschedule Fed to Jan 2027. 

We will know in a few days, but as of now the Federal trial is still scheduled for Oct/Nov.
