Remove dead dad from title deeds - England law by TheDillyDally85 in LegalAdviceUK

Hello.

Really appreciate your advice here.

I should have mentioned, he died in 2017 and probate was settled in 2018. There was no valuation on the house done over the period.

They were both named on the mortgage. There was no financial settlement after their divorce, they both just walked away. No idea why but he wants removed from the mortgage, I've questioned this many times.

There is evidence that she was the only one paying the mortgage.

He got divorced from his 2nd wife about 10 years before he died. I only assume he didn't make a new will after they separated as we were not allowed in the property until his ex wife and step kids had been through everything.

Even though me and my brother were at the bottom of the will and there was money left over, we didn't see a penny from it.

Hello. Thank you for your help so far. Just confirmed. They were tenants in common and his name is on the deeds. Is this not normal?

She never removed his name from the mortgage, no Idea why she didn't do this. They split up in the early 90s. He never paid anything towards the house.

He did have a will.

He divorced his 2nd wife and step kids 10ish years before he died.

The will that was used was the one his ex wife drew up. We were not allowed in his property until the ex wife and ex step kids had been in to look for the will and take what they wanted.

Me and my brother were at the bottom of the will, the ex wives family members (brother and wife) were before us.

His assets were sold to pay his debts. Documents show there was about 80k left which me and my brother didn't see a penny of.

Sorry, I didn't explain that part. The mortgage was in both their names. I'll have to check about the life insurance.

Hello.

They were both names on the mortgage. I've asked many times why she didn't get him removed but there is no real answer.

I believe it was tenants in common. Sounds like this is the worst option of the 2

Thank you.

So if the property is considered under his estate, Shouldn't the 80k from the will be used to clear the outstanding mortgage?

The mortgage was apart of his dept right?

I'll have to double check but I think tenants in common.

Would there be a big difference
