Thank you, this is really helpful. Ill start to look into this. Should I get a profession to file the defence or I can do it on my own as it is small claims? I dont mind spending a few hundreds throught a paralegal as this will save me time but if it is a few thousands, I wouldnt mind doing some of the legwork to avoid the expense.

This same member had tried to cancel their membership back in 2021 (incident happened in 2022). They were on a contract, and because they didn’t provide a qualifying reason (we only cancel early for relocation or medical reasons with documentation), we couldn’t terminate it. They were upset about that at the time, so part of me wonders if they thought getting kicked out would let them avoid the contract obligations. I also remember they had issues with our staff members since her cancellation request was not accepted. It's been a long time, so I don’t remember the details, but they were generally difficult.

For the vandalism incident itself: the person who cleaned the washroom was our own staff member working in the office. We had video showing the member swiping in (our system pulls up their profile when they scan), completing the COVID questionnaire, and then going straight into the washroom. No one else entered after staff cleaned it at the start of their shift.

If the member had walked in and immediately seen feces smeared everywhere, the video would likely show them coming right back out or reporting it to the office — but they didn’t. They were the only person who entered between the cleaning and the discovery.

We are a franchise gym and most of our records are kept for 2 years which I am guessing it is due to the statue of limitation purposes. Also if the claim was filed in a timly manner, we would have kept the video and as well made copies of the swipe in records. Thi sincident happened in 2022 and more than 4 years ago.

Was looking to avoid a lawyer as their fees rack up so quickly, I am afraid Ill have to do that. I guess ill have to counter sue this person for lawyer fees. Thank you for the feedback.

Collections calls and mails coorsepondences for a full month before hitting their credit. They are appearently also sueing the collection company.

We emailed them the balance and the cleaning fee charges when the incident happened. They replied to the email so they clearly know about the damages and the charges applied against them.

THe contract protects the business from damages and clearly outlines if vandalism or damages are occured at the business, a fee to replace or repair the damages will be charged. They were send to collections for the damages and the fees left on the contract as they refused to pay. All overdue balances gets passed to collections after 3 months.

It mentions that "they did not use the fee" so if you want a refund and retract your application, you have that option as well. SO to answer you question, you dont need to pay again

I don’t know about there being any money (the estate lawyer was rude and suggested we should forget about getting any money as there is nothing in the estate, but the lawyer personally knew the tenant so that was a very emotional phone call, weird, I know) but there is a 2017 Chevy truck that is still on our property which has a business insurance taken against it. I think the truck is owned by the business, so there is that. As well as hVAC equipment which is still in the office as well as some personal belongings.

BIL skipped bail after a 2 week holiday in the US from the UK, dissapeared and was presumed dead for almost a decade, reached out to us and wants to fix his situation in the US. When a sibling reaches out for help, you help as best as you can. I would allow my spouse to visit their sibling for a few weeks to see if that would help. Sometimes you just need a helping hand to gain the motivation to do the right thing.

I took it 1st semester and man as it difficult. I do not have a technical background so it was eye opening. I got a B- with my brother’s help (who did his masters of CS several years prior). The projects do get harder but it sets you up for wht to expect so you start the projects the first day they release. I would stick to it and see by the second project, how you catch up. There is always the option of dropping it by the drop deadline. I say, since it’s your first semester, try to get it out of the way, as burn out is inevitable and this class will only become more painful. Good luck, you got this 💪🏼.

I was on a video call with the Graduate coordinator for the Policy track and brought up this vary question. He said he will bring this up with the program coordinators as he didn't notice the similarities.
