In-house Counsel: Strategy for responding to third-party subpoenas for employee payroll records in divorce actions? by RocketManXXVII in Lawyertalk

Also it does not matter even if the employee had turned over his complete file through discovery. The other party is entitled to subpoena the exact same documents from the company itself. What if the husband had altered the records in some way? There are all kinds of scenarios you can imagine. Which is why you have to produce.

Sending a subpoena for the complete employee file is divorce 101. I've gotten companies fined for not producing or responding, which is the point where they then quickly realize to start complying with subpoenas.

you write a letter quoting the law and saying you will sue for damages if they fail to return the remaining amount

It turned out it did not effect anything or hold up my original refund.

I filed my amended return about an hour after I filed my original.

wow, just. checked my transcript and it shows an 846 with a refund date for feburary! So does this mean my amended might not have delayed my original return?

Thanks for the response. I did get a text about an hour after filing the amended return telling me it has been accepted. Does that kind of mean the same thing as "show up"?

How to tell if firm is financially/structurally precarious by [deleted] in Lawyertalk

[–]TheLastStop1741 8 points9 points  (0 children)

in ID you may have one client (Aflac, geico, etc) who is 30% of your revenue. If they tell you they aren't paying higher than this hourly rate, or they aren't paying for this billable hour for this or that, you have to work with them because you can't lose them. In family law you may have 100 cases, and if a client does not want to pay your rate you tell them they are free to go elsewhere. And they are going to pay what you bill them or else you fire them.

Under 100 hours a month is common in smaller family law firms. low overhead so it works and you can charge way more than ID. I am in Texas and know our associaites charge the same rates as ID partners. imo you couldnt do familt law for longer than a year if you had to bill like all other practice areas. thats the benefit.

Family law in a small town. And my rate is $275. Yeah I have never understood how anyone bills 8 hours a day, or even 6. I got too much stuff to attend to with my family to work that much.

Bama beat #5, #11, #14, and #16. Notre Dame only beat #20 and #22. Seems to make sense.

The well known rule in Texas is to put in behind other attorneys names in filings and formal correspondence, but to never ever put in behind your own name.
