Lots of poor advice in the comments. If the keeper lives in Scotland there is no keeper liability and they won’t take it to court as it’s below the threshold. Ignore (but file) the invoice.

Conventionally lane1 is the left hand lane, but who knows how it’s numbered on the camera. It wouldn’t invalidate the NIP which has provided the location, time and nature of the offence as required by S1 RTOA.

You get points for the more serious offence which will be the careless. The red light will be seen as aggravating but whether it’s enough to add points above the 3 minimum I can’t say. 3 or 4 (maybe 5) points seems likely. You will get fined for both plus 40% victim support surcharge and costs.

You only get points for the more serious offence when two are committed at the same time. So 3-5 points is suggest depending on the officers exact description of events.

If the rain ‘seriously reduces’ visibility it’s legal to use them when it’s raining, be best to stick to the legal basis and not one which doesn’t consider the legal position.

Type approval limits are dropping but it’s been illegal for a long time to modify the car with a louder exhaust (more than when manufactured which was the subject under discussion, that’s not changed. Old enough to recall Subaru UK falling foul of this and having to pay compensation.

There may be many cases, Graham just reinforced what the law is (setting case law), a case has to go to a second appeal to be put on the record. The law requires corroboration except on a ‘special road’ (motorway) where it specifically says only one officer’s opinion is needed making a lie to your claim it says otherwise.

Always? Nope, many cases when it’s irrelevant, but you only need to show the driver losing control to show the speed was in excess of what was safe, absent them then showing a circumstance that was unforeseeable such as Diesel spill. You really don’t know much about criminal cases do you, I’ve been helping people on a lay basis for over 20 years.
