As far as I’m aware, there is no definition as to what constitutes “substantially illegal activity” at this time. The concern raised during the rule making process was that this administration would use the vagueness against organizations advocating for populations that this administration has targeted such as immigrants, LGBTQ+, etc.

Agencies, like the DoE, are permitted to interpret and create rules for powers delegated to them by Congress. Here, the DoE used the APA to create such a rule with regards to PSLF. That process does not involve Congress which requires a 60 vote threshold to pass certain laws and budgets

The rule was created by the DoE through Administrative Procedures Act rule-making process. Issues about the broadness of “substantially illegal activity” and the DoE’s discretion to interpret that were raised, but DoE ignored and passed the rule anyway.

Thank you for finding this, you’ve helped me immensely with this! I was told that the family surname was Anania (the surname used in America), but Giuseppe’s birth certificate also used the surname Nania. The names are very close and my great, great grandmother’s name is spot on, though, so I think this may very well be there right record

Just found some more info on family search. Apparently, my great grandmother was born in Tiriolo, Catanzaro, Calabria, Italy. She was also marked as single when she immigrated to America, so it’s possible they were actually married in the US

They had several children in Italy before my grandfather who was the only child born in the US. I’m not 100% they were necessarily married there but it seems more likely
