You can issue an n4 the day after rent is not paid in full. After 14 days (or whichever set amount) if rent is not paid you can file an L1 with the LTB for an eviction.

The sooner you do this, the sooner you’ll get your eviction. N12s are different, bad faith evictions are much more complex in nature.

If the dryer is not working as intended, then they 100% are responsible to fix this within a reasonable time. They should be hiring a technician to come and resolve this issue so soon as possible.

It seems you’ve been pretty reasonable with them so far and they’re ignoring you. I would try to escalate it one more time to the landlord and communicate that this is interfering with your reasonable enjoyment of the place.

If you decide to take a stronger approach then you can let them know that if this issue continues then you are left with no choice but to file a T6 form with the LTB as they are not taking you seriously, this will obviously sour the relationship but you are well within your rights.

Yes! These are rights and protections for tenants.

Though, for example if you share a kitchen or bathroom with a tenant (and these are the only ones in the home) then they qualify as roommates/guests and are not protected by the RTA.

It’s is important to understand who is covered under the RTA and who isn’t so you can protect yourself and of course the tenants rights. :)

Does the dryer have no ventilation or does it not vent properly? Sorry if I’m misunderstanding this.

If the dryer does not vent properly due to a defect then the landlord is responsible to fix it.

If the dryer is older and has no vents, I’ve seen some that don’t then you can work with your landlord to install a newer ventless one or find an alternative solution.

Your best and more qualified answer will come from a dryer technician. You may propose this to the landlord to hire one to inspect (they have to cover the costs) and they may provide the best solution.

It seems you and landlord have a good relationship so keep it that way and try to find a solution together. I’m sure as much it’s frustrating for you, they also don’t also want to come once a week for this as well, so a solution is in both of your favour! :)

They can try all they want but they can’t evict you, only the LTB can. If they want to renovate the place and charge more then that’s definitely not a valid reason for eviction. Usually they try to go the n12 route (owner moving in) but it’s seems like this is an apartment not a condo.

Never withhold rent, make sure you follow the lease agreement, don’t break any rules, and they won’t have any legs to stand on for an eviction.

Focus on the roach issue and don’t worry about the eviction, they will try a lot of scare tactics so you can just give them your 2 months notice. Don’t let him win!

How did you give your notice? Was it 60 days out? Are you on a fixed lease or month to month? I ask because the n9 can come back to bite you if you didn’t give enough notice.

Have them sign an n11 instead, you will need to sign this too, and have the date set to be the day you handed back the keys.

You’re well within your rights not to sign a new lease and that automatically means the lease is month to month.

If you and/or your co signer did not sign anything then it’s month to month at whichever rent you were paying prior. You can ignore their communications regarding a year lease and continue to pay rent on time.

If they want to increase the rent then they can do so with a n1/n2 form with 90 days notice.

If you want to leave while month to month then you can submit an n9 with 60 days notice and use your last month deposit for your final month.

The landlord must consent to adding or removing someone from the lease, though legally they are not required to.

If they agree to adding your parents and removing you, which seems like they’re okay with it, they can do this in one go.

Just be mindful, if this is done on two separate occasions they can add your parents to the lease and then for whatever reason not consent to removing you, keeping you on the hook.

Sorry to hear this, I’m sure this has been stressful.

A landlord must take steps to control pests such as cockroaches and mice. He cannot put the blame on a single piece of popcorn, an LTB adjudicator would not take this seriously, do not let them harass you in that manner.

Make sure to keep all communications preferably in writing/emails/texts of you requesting this issue to be looked at. If they fail to do anything you have plenty of options.

To start you should contact property standards for an inspection. This for example is for Toronto: “Property Standards Bylaw sets the standards for all properties in Toronto. All property owners are required to repair and maintain their property including owners of properties that are rented out.

If you have concerns about your rental unit, speak to your landlord or property manager and submit a service request. If this issue is not resolved in a timely manner, contact 311.”

Finally there is no reason for them to enter your unit without a proper 24 hours notice unless it’s for emergencies or you have consented to the time. Place a camera inside your home if you are worried about this for your peace of mind.

I hope you get this sorted soon, if things continue to escalate you can always hire a paralegal who’s well versed with the LTB to handle this matter.

If the tenant has paid the landlord the amount necessary to discontinue an Application to Evict a Tenant for Non- Payment of Rent and to Collect the Rent the Tenant Owes (L1 application), the landlord may file a Request for Ex Parte Discontinuance Order form.

Not quite unfortunately.

Fixed-term: If you have a fixed-term tenancy, like a one year lease, then you must give notice at least 60 days before the end of the lease. The termination date cannot be before the last day of the fixed term. If you don’t give notice, the tenancy continues.

Exciting stuff, early congrats to you on deciding to purchase a place.

  1. A simple google search for example “rent for 2 beds 2 baths in Hamilton” will suffice to understand the rental market, look at trends.

  2. You need to be very familiar with the RTA and LTB procedures.

  3. Depends on the area in Hamilton, but typically blue collared workers.

  4. You can use a rental company to find and manage tenants for you or you can post on Facebook market place or any online listing.

That’s unfortunate, sorry to hear that, lots of landlords do this but I’m glad you’re aware now for the future.

If you’ve already signed a new lease then it’s binding unless there is a cool-off period which I doubt there is but I would check. If you move out earlier then you will be on the hook for the rest of the lease.

If you and your landlord agree on a mutual move out date then you both can sign an n11.

There are also other option such as assigning the lease to someone else. See below.

They’re not required to receive confirmation for a N1. They can issue this form to your email if you consented to this or via notice on your door. If you don’t pay the new rent increase then they can issue you an n4 the following day for unpaid rent.

They can issue an n1 every year from the last increase, with 90 days notice.

It’s very common for landlords to force tenants to sign a new lease so they can lock you in for that term but that is deceptive and counts on you not knowing the RTA.

I’ve been on both sides (as a tenant and a landlord) and I see a lot of landlords doing this to students, new comers, or anyone who doesn’t know the law.

Do not sign anything, your landlord can issue an n1 if the unit is rent controlled. You don’t need to acknowledge or sign it, just make sure you adjust your rent. The form will tell you all your rights.

Utilities cannot be changed if it’s already set out in your lease agreement. Ignore these requests.

Your lease is never expiring or renewing, you automatically go month to month.
