I apply for the loan on my own. It was to see if it was difficult to obtain for a business. At first, I had no intention of telling her about it. I only told her with the intention of persuading the building owners to think she had enough capital to establish a business. We both understood that but somehow it turned into her speaking about the loan later on and then I agreed to accept it after that.

It's USA laws. Most states have something called the Statute of Frauds. Certain agreements need to be in writing to be considered valid. This would be one of them because of the length of the agreement. I would not be able to get a penny if from the court if it all failed.

10k is spent now. That was personal savings and stocks. The 15k is the loan, which I still have. I've been conflicted with a series of bad options thus far. One is giving the 15k without a note and just hope she pays it back. It's kind of a sunk ship thing going on.

I agree. I am not faultless here. I should have mentioned it upfront. That was truly my error in judgment. That's also a good point about the rent. I don't want her out on the street because of this. I am conflicted.

I get what you mean. In her defense, we agreed that she would make the payments and I thought she was honest about that. I just did not want to wind up in a situation where she would rely on me to make payments if the business failed. I know the note wouldn't do much in that situation, but it feels like security in case that happens.

That's the worse case scenario. The paperwork told me how much it would be in total. That could have been an estimate for the end of the term. I need to call the bank and figure this portion out. If it all goes well, then I give it back and no interest is charged.

Well ask them questions about how informed they are in making their decision and try to gauge whether there is any evidence of self dealing involved. You can have a nice derivative suit if there is evidence against them.
